The Board may vote to meet in a closed executive session to discuss certain matters and for legal advice on any item as indicated on the following agenda, pursuant to A.R.S. § 38-431.03(A)(3). Items on the agenda may be considered out of order at the Chairperson's discretion. AND I PRAY THAT THOSE WHO ARE ON VACATION OR WILL BE ON VACATION, GIVE THEM SAFETY AND PROTECTION IF THEY'RE TRAVELING AND SAY THAT, UM, THEY ENJOY TIME WITH FAMILY, CHILDREN, RELATIVES.

SHE WAS INDEED A PHENOMENAL EXAMPLE AND WONDERFUL HUMAN BEING WITH SO MUCH CARE AND CONCERN FOR HER FAMILY, HER FRIENDS, AND HER COWORKERS.

SHE WAS AN IDEAL GUIDING SOURCE IN THE TRUE SENSE, A HEARTFELT THANK YOU FOR ALL SHE HAS TAUGHT ME, WHICH I SURELY WILL BE FOLLOWING THROUGHOUT MY LIFE.

I WILL ALWAYS CHERISH EACH MOMENT I WAS ABLE TO SPEND WITH HER.

SHE HAS LEFT A LASTING IMPRESSION ON ME.

I WILL PROUDLY CARRY ALL THE FOND MEMORIES OF HER.

GIANNA WAS A SPECIAL PERSON.

SHE ALWAYS HELPED ANYONE WHO ASKED.

ALONG WITH WORKING IN THE ASSESSOR'S OFFICE, SHE WAS A MEMBER OF THE CARE COMMITTEE FOR SEVERAL YEARS.

JANA HELPED WITH THE COLLEGE ESSAY, WHICH ASSIST IN FUNDING NAVAJO COUNTY EMPLOYEES, CHILDREN'S FUTURE EDUCATION WHEN IT COMES TO THE ASSESSOR'S DEPARTMENT.

SHE WAS WILLING TO HELP ANY WAY SHE COULD.

SHE WAS FAWN AND ENTERTAINING WHEN IT CAME TO THE CHRISTMAS PARTIES AND THE TEAM BUILDING DAYS.

HER WITTY, QUICK, QUICK RESPONSE AND CONTAGIOUS LAUGH MADE HER THE LIFE OF THE PARTY WHEN IT CAME TO WORK.

SHE WAS FULL OF KNOWLEDGE AND PERFECTION AND SHE TOOK PRIDE IN HER WORK.

SHE TOOK IT UPON HERSELF TO CONTINUE LEARNING AND GAIN FULL COMPREHENSIVE INSIGHT INTO THE, THE MANY DUTIES SHE HANDLED, INCLUDING AG AND LAND APPRAISAL, MAKING HER AN ASSET TO OUR OFFICE.

JANA WILL BE DEEPLY MISSED BY ALL WHO HAD THE PRIVILEGE OF KNOWING HER.

THEY'RE REQUESTING FINANCIAL ASSISTANCE FOR THE EXTENSION OF SEVENTH STREET SOUTH PROJECT FOR THE AMOUNT OF, UH, NOT TO EXCEED $120,000.

THIS IS A PROJECT IN THE TOWN OF SNOWFLAKE.

UM, IT'S AT THE LIGHT THERE BY A PS AND MAVERICK.

IT WILL, THE PROJECT WILL EXTEND SEVENTH TO THE EAST AND THEN TO THE SOUTH TO CONNECT INTO SECOND STREET.

THAT ALREADY EXISTS TO THE SOUTH OF THERE.

THIS PROJECT WILL PROVIDE MORE CONNECTIVITY IN THAT AREA OF THE TOWN AND WILL BENEFIT THAT AREA OF THE TOWN QUITE A BIT.

THE PROJECT HAS BEEN DESIGNED BY A LOCAL ENGINEERING FIRM AND THE REQUEST IS TO PROVIDE UP TO $120,000 FOR THE CONSTRUCTION OF THE PROJECT.

UH, BUT I WANTED TO BRING UP HOW THIS CASE HAD COME FORTH ONCE AGAIN, UM, JUST BECAUSE THIS HAS BEEN WITHIN THE CHAMBERS OF THE BOARD OF SUPERVISORS AS WELL AS THE PLANNING AND ZONING COMMISSION.

SO THIS ITEM WAS PREVIOUSLY TABLED BY THE BOARD OF SUPERVISORS ON AUGUST 27TH, 2024.

AND THAT TABLING WAS TO ENSURE THAT WATER SUPPLY WITH THE CITY OF SCHOLA WAS ADEQUATE AND GUARANTEED.

AND THEN THAT TRAFFIC CONCERNS FOR THE DEVELOPMENT HAD BEEN HANDLED APPROPRIATELY.

UH, AS FAR AS ROUTING AND INFRASTRUCTURE IMPROVEMENTS THAT MIGHT BE REQUIRED, THE APPLICANT HAS NOW PROVIDED AN UPDATED TRAFFIC REPORT FOR THIS AND HAS UPDATED, UH, WILLS SERVE FROM CHOLO.

UM, ON THE CHOLO SIDE, IT, IT SEEMS IT WAS JUST A MISCOMMUNICATION THEY DID HAVE THAT WILLS SERVE, BUT THEY HAVE CONFIRMED THROUGH WITH THE, THE CONDITIONS AND WHAT'S NECESSARY THERE WITH THAT TABLING, UM, THE VICE CHAIRWOMAN FELT IT WOULD BE APPROPRIATE AS DID THE BOARD THAT THIS BE HEARD IN FRONT OF THE PLANNING AND ZONING COMMISSION ONCE AGAIN, UM, JUST BECAUSE OF THOSE CHANGES THAT THEY COULD BE CONSIDERED SUBSTANTIAL ENOUGH THAT IT COULD CHANGE THEIR, THEIR VIEWPOINT ON THE PROJECT.

UH, SO THIS ITEM DID GO IN FRONT OF THE PLANNING AND ZONING COMMISSION ON THURSDAY, APRIL 17TH, 2025.

AND AT THAT HEARING, THE PLANNING AND ZONING COMMISSION DID UNANIMOUSLY RECOMMEND APPROVAL WITH THE AMENDED AND UPDATED DOCUMENTS, WHICH HAVE BEEN INCLUDED IN YOUR PACKETS JUST TO GO BACK INTO THE PROJECT, UM, FOR FAMILIARITY BECAUSE IT'S, YOU KNOW, BEEN SINCE LAST AUGUST.

SO IT'S BEEN A LITTLE WHILE FOR THE BOARD.

WANTED TO GO THROUGH THE DETAILS ONCE AGAIN BEFORE GETTING INTO THOSE UPDATED DOCUMENTS.

THIS PROJECT IS ABOUT A MILE AND A HALF TO THE WEST OF STATE ROUTE TWO 60, OR, UH,

WHITE MOUNTAIN BOULEVARD AS IT'S MORE COMMONLY KNOWN FOR THE, THE CITIZENS WITHIN HERE.

THIS WAS PREVIOUSLY APPROVED FOR A MASTER DEVELOPMENT PLAN AS STARLIGHT RIDGE ESTATES.

UNIT THREE, UH, UNITS ONE AND TWO HAVE ALREADY BEEN PLATTED AND PARTIALLY DEVELOPED.

WAIT AND SEE IF THE SCREENS POP BACK UP HERE IN JUST A SECOND BEFORE I PROCEED.

IT'S ALL GOOD.

WE, WE ARE USED TO IT.

UM, SO ON THE TOP THERE YOU HAVE THE, THE FIVE PARCELS THAT CONTAIN THIS PROPOSAL FOR THE AMENDMENT TO THE MASTER DEVELOPMENT PLAN ON APPROXIMATELY 53 ACRES, THIS PROPERTY IS ALREADY ZONED SPECIAL DEVELOPMENT AND AS FAR AS A PROJECT DESCRIPTION, IT IS APPROVED FOR A MINIMUM OR A MAXIMUM OF 80 SINGLE FAMILY HOME UNITS THAT PROPOSED TO USE AS NOTED BY THE CHAIRMAN WITHIN THE DESCRIPTION IS 49 SINGLE FAMILY LOTS AS WELL AS 74 TOWN HOME UNITS.

AS A REMINDER TO THE BOARD, THOSE 80 SINGLE FAMILY HOME UNITS ARE ALREADY A, UH, A VESTED APPROVAL FOR THIS PROJECT.

SO IF THIS AMENDMENT WERE NOT TO BE APPROVED, THAT APPROVAL WOULD NOT GO AWAY.

THIS WOULD ONLY DO THE UPDATE TO THE NEW USES AND DENSITIES THAT ARE THERE.

UM, ALSO AS A PART OF THIS, THIS IS ONLY APPROVING THOSE NEW USAGES AND DENSITIES.

SO YOU HAVE, UM, THE, THE DENSITY IS THERE FOR THE SINGLE FAMILY IN THE NORTH, AND THEN YOU HAVE THE CLUSTER DEVELOPMENT, UH, MULTIFAMILY IN THE SOUTH.

THESE ARE YOUR TYPICAL LOT SETBACKS ON THE LEFT OF YOUR SINGLE FAMILY.

UH, THIS VERY CLOSELY MIRRORS OUR R TWO AND R THREE, UH, ZONINGS WITH SOME ADDITIONAL SIDE SETBACKS TO THAT OF 10 FEET, WHICH IS IN EXCESS OF THE FIVE FEET THAT YOU WOULD SEE THERE.

AND THEN YOU ALSO HAVE TYPICAL TOWNHOME SETBACKS.

UH, SO THERE WILL BE, AS THOSE ARE TOWN HOMES, YOU'LL HAVE SOME, SOME SHARED WALLS.

THIS WAS A TENTATIVE PLAT THAT WAS APPROVED WITH THOSE ORIGINAL 80 SINGLE FAMILY RESIDENTIAL UNITS SPREAD THROUGHOUT THE PROPERTIES.

SO AS FAR AS THAT FURTHER REQUESTED INFORMATION, THIS IS A COPY OF THE WILL SERVE THAT WAS SUPPLIED BY THE CITY OF CHOLO FOLLOWING THAT LAST HEARING, CLARIFYING THAT THEY WILL SERVE FOR WATER, THAT THEY HAVE THE INFRASTRUCTURE IN PLACE AND THAT THEY ARE ABLE AND WILLING TO DO SO PROVIDED THE DEVELOPER MEETS ADEQUATE CONDITIONS.

THERE WERE CONCERNS OVER RIM ROAD AS A RESULT OF THOSE CONCERNS THAT EXISTED.

UH, THE DEVELOPER WENT BACK AND GOT A NEW TRAFFIC REPORT COMPLETED TO SEE IF THERE WAS A WAY TO ROUTE THIS WITHOUT UTILIZING RIM ROAD ON THE PROJECT.

THEY HAVE PREPARED THIS FULL REPORT, UH, THAT INCLUDES HOW THAT COULD BE UTILIZED AND WHAT INFRASTRUCTURE IMPROVEMENTS MIGHT BE NECESSARY.

THIS REPORT HAS BEEN REVIEWED BY WILL FLAKE COUNTY ENGINEERING AND DEEMED ACCEPTABLE AT THIS POINT AS FAR AS THE ASSUMPTIONS THAT HAVE GONE THROUGH WITH THE IMPROVEMENTS THAT WOULD BE NECESSARY.

AS FAR AS OUR RECOMMENDATION, WE ARE STILL RECOMMENDING APPROVAL OF THE MASTER DEVELOPMENT PLAN AMENDMENT FOR STARLIGHT RIDGE ESTATES SUBJECT TO THESE 11 CONDITIONS.

UH, ONE OF THOSE CONDITIONS THAT WAS ALTERED OR ADDED ON, UM, WAS THAT WE WOULD NEED TO HAVE THE FINAL ACCEPTED TRAFFIC STUDY AS A PART OF THIS.

UM, SO WHILE THAT HAS BEEN TENTATIVELY ACCEPTED, ACCEPTED THROUGH ENGINEERING AS THEY MOVE THROUGH THE TENTATIVE AND FINAL PLATS THAT WE WOULD NEED, THE FINAL ACCEPTED REPORT AND CONDITIONING REGARDING THOSE INFRASTRUCTURE IMPROVEMENTS, PLANNING AND DEVELOPMENT SERVICES DID INITIALLY RECEIVE 13 COMMENTS AND OPPOSITION OF THIS PROJECT.

WE'VE RECEIVED MANY COMMENTS AND WE'VE GONE BACK AND, AND RECEIVED THOSE ADDITIONAL REPORTS.

REVISE THE, THE PLAN TO GET TO, TO SOMETHING THAT THE COUNTY CAN AGREE WITH AND HOPEFULLY WILL BENEFIT THE AREA, UM, AND ALSO PROVIDE THAT HOUSING.

UM, WE'RE HOPING THAT, THAT NOW WE HAVE COME TO A PLAN THAT WON'T REALLY AFFECT TOO MUCH.

SO WHATEVER MEASURES WE CAN CONTINUE TO MAKE THERE TO IMPROVE THAT, I HOPE THAT WE CAN.

I, AS I RECALL THE PUBLIC HEARINGS LAST TIME WHEN THIS CAME BEFORE US, SOME OF THE PEOPLE WERE CONCERNED WITH SOME OF THE QUALITY OF CONSTRUCTION, SOME OF THE QUALITY OF MATERIALS AND THINGS THAT WERE BEING USED ON THE, UH, UNITS.

AND, AND RIGHT NOW THE, THE PHASE THAT WE HAVE THIS, UH, BEING WORKED ON IS JUST ROADS AND JUST, UH, SINGLE FAMILY DWELLINGS THAT PROBABLY WON'T BE BUILT BY THIS DEVELOPER.

BUT WHEN WE GET INTO THE, UH, CONDOMINIUMS AND THE TOWN HOMES, THEN I THINK THAT'S WHERE WE REALLY NEED TO TRY TO MAKE SURE THAT IT'S A LITTLE MORE QUALITY THAN WHAT WAS PREVIOUSLY BUILT.

AND I THINK THAT WAS SOME OF THE CONCERNS OF THE CITIZENS AT THAT TIME.

SO WHETHER WE CAN MAKE THAT A CONDITION OR JUST, UH, ADVISE THE APPLICANT OF THOSE REQUESTS, UH, I'D BE WILLING TO, YOU KNOW, THAT'S JUST MY CONCERNS WITH IT.

BUT I THINK IT, AND THEN WE AREN'T GUARANTEED AT THE OPEN SPACE.

THERE WILL BE, IT'S NOT SHOWN, BUT I BELIEVE THERE'S SOME OPEN SPACE THAT WILL GO BETWEEN THE HOMES THAT ARE GOING TO BE SITE BUILT VERSUS THE, THE TOWN HOMES ON THAT PLAN.

SO, AND I JUST, UH, HOPE THAT THOSE ARE AMENITIES THAT ARE PUT IN ARE OF, OF A QUALITY NATURE FOR THE WHOLE SUBDIVISION.

VICE CHAIRWOMAN WEINGER, UH, CHAIRMAN ON THIS ITEM, THOSE ROADS THAT ARE WITHIN THERE, DEPENDING ON THE LEVEL OF IMPROVEMENT COULD BE ACCEPTED INTO THE COUNTY MAINTENANCE SYSTEM, HAS ALWAYS BEEN MY UNDERSTANDING.

UM, BUT THE ROADWAYS OFFSITE ARE ONES THAT ARE ALREADY WITHIN THE, THE PUBLIC MAINTENANCE SYSTEM.

SO THAT WOULD FALL WITHIN THE COUNTY'S MAINTENANCE.

HOWEVER, THE IMPROVEMENTS THAT WOULD BE NECESSITATED AS A RESULT OF THE PROJECT WOULD BE THE RESPONSIBILITY OF THE DEVELOPER FINANCIALLY AND, UH, BASED UPON STATE LAW AS WELL AS OUR ORDINANCES, THAT IS SOMETHING THAT WE WOULD HAVE TO HAVE BONDED UP FRONT ON THESE PROJECTS TO SECURE THOSE FUNDS TO ENSURE THAT THOSE IMPROVEMENTS WOULD GO IN AT THE APPROPRIATE STAGE.

UM, SO AS FAR AS THE GENERAL IMPROVEMENTS NECESSITATED TO AT LEAST BRING IT UP TO A MAINTENANCE LEVEL THAT'S APPROPRIATE FOR US, THAT WOULD BE THE RESPONSIBILITY OF THE DEVELOPER.

AND I, I APPRECIATE THAT AND I THINK, YOU KNOW, THE

UM, WITHIN THIS PERIOD, WE ALSO ADOPTED THE NEW COMPREHENSIVE PLAN UPDATE, WHICH WAS ADOPTED BY THIS BOARD IN JANUARY.

AS A PART OF THAT COMPREHENSIVE PLAN UPDATE, THE ONE OF THE RECOMMENDED IMPLEMENTATION TASKS WAS TO DO A FULL UPDATE OF OUR ZONING ORDINANCE.

AND THEN THERE WERE OTHER TASKS THAT RELATED SPECIFICALLY TO RENEWABLES, WHICH WAS AN ONGOING CONVERSATION FROM OUR COMMUNITY.

UM, SO WHILE UPDATING RENEWABLES, OUR STAFF TOOK THAT OPPORTUNITY TO ALSO UPDATE THE ZONING ORDINANCE AS DIRECTED BY OUR COMPREHENSIVE PLAN.

AS A SUMMARY OF OUR CHANGES, THE PROPOSED COMPREHENSIVE UPDATE INCLUDES REVISED ZONING DISTRICTS ADMINISTRATIVE PROCEDURES FOR CODE ENFORCEMENT AND CODE COMPLIANCE PERMITTED AND SPECIAL PERMITTED LAND USES FOR EACH ZONING DISTRICT THAT ARE SPECIFIC DEVELOPMENT STANDARDS, COUNTYWIDE PROVISIONS AND STANDARDS, AS WELL AS UPDATED LAND USE DEFINITIONS THAT WERE QUITE OUTDATED.

UM, ALL OF THE SECTIONS OF THE ZONING ORDINANCE HAVE UNDERGONE SOME FORM OF UPDATE.

THE SECOND USE IS ANTIQUE STORES IN THE NEXT APPROXIMATELY 80 USES COVER COMMERCIAL USAGES, BUT FOR A PROPERTY OWNER OR DEVELOPER TO UNDERSTAND WHAT USES ARE ENTITLED, THEY THEN HAVE TO GO TO R THREE TO SEE WHICH ZONING DISTRICT USES ARE ALLOWED THERE.

ADDITIONALLY, WITHIN THIS IN OUR ZONING DISTRICTS, WE HAVE SOME LIKE RU 20, RU 10, RU FIVE, AND RU ONE.

THEY ARE RURAL ZONING DISTRICTS.

THEY GENERALLY ALLOW FOR SINGLE FAMILY RESIDENTIAL AND FARM USAGES.

UM, THEY HAVE THE SAME USES ARE ALLOWED WITHIN EACH OF THESE.

THOSE NUMBERS TWENTY TEN FIVE AND ONE ARE THE MINIMUM ACREAGE THAT'S ALLOWED FOR THE PROPERTIES WITHIN THOSE FOR THE DENSITIES.

UM, THEY ALSO HAVE SOME DIFFERENCES WITH LOT WIDTHS AND OTHER INTENSITY OF USE REGULATIONS, BUT ALL USES ARE THE SAME.

SO IF YOU'RE GOING THROUGH RU TEN FIVE OR ONE, YOU WOULD AGAIN HAVE TO FLIP TO ANOTHER SECTION OF THE ORDINANCE TO GO THROUGH AND FIND THE USES ALLOWED IN RU 20, WHICH ARE THEN ALLOWED IN THAT ZONING DISTRICT BECAUSE ALL USES WERE THE SAME AND ONLY THE DEVELOPMENT STANDARDS DIFFERED.

WE COMBINED THESE INTO ARTICLES OF A RURAL ZONING DISTRICT THAT TELLS YOU ALL USES ALLOWED WITHIN THOSE DISTRICTS AND THEN CREATED A CHART OF DEVELOPMENT STANDARDS THAT SHOWS YOU WHERE THAT WOULD DIFFER BETWEEN THE FOUR ZONING DISTRICTS UNDER THAT CATEGORY.

AGAIN, TRYING TO MAKE THIS EASIER FOR THE USER.

AS FAR AS OUR ADMINISTRATIVE PROCEDURES, THESE COVER OUR CODE COMPLIANCE PROCESS.

THOSE DON'T REQUIRE HEARING IN FRONT OF THE BOARD OF SUPERVISORS, BUT THEY DO REQUIRE, REQUIRE SOME ADDITIONAL STAFF REVIEW TO ENSURE THAT THEY'RE APPROPRIATE FOR THE GIVEN DISTRICT AND PROPERTY.

HOWEVER, WITHIN OUR ORDINANCE AS IT EXISTS, THERE'S NO INDICATION THAT THOSE ADMINISTRATIVE PERMITS ARE REQUIRED UNLESS YOU GO TO FURTHER SECTIONS TO UNDERSTAND THEIR REQUIRED.

WHAT WE FIND FOR PEOPLE WHEN APPLYING FOR THINGS LIKE GUEST HOUSES IS THEY'LL COME APPLY FOR THEIR BUILDING PERMIT, AT WHICH POINT THEY'RE TOLD YOU NEED TO ACQUIRE YOUR ADMINISTRATIVE GUEST HOUSE PERMIT THROUGH A REVIEW.

WE DO PROCESS THOSE, UH, RATHER RAPIDLY ON OUR SIDE, BUT IT IS FRUSTRATING FOR THE USER BECAUSE THEY FELT THAT THEY HAD GONE FORWARD IN THE APPROPRIATE MANNER.

AND THEN THERE'S AN ADDITIONAL STEP THAT THEY FEEL HAS BEEN TACKED ON TO THE END.

BEYOND THOSE, THEY'RE ALSO THE SPECIAL USES THAT COULD BE APPLIED THAT ARE MORE INTENSE THAT THE BOARD IS FAMILIAR WITH AS THOSE HAVE COME IN FRONT OF THE BOARD.

AND THOSE USAGES, UM, DO REQUIRE SPECIAL USE PERMIT HEARINGS, UH, FOR CERTAIN ZONING DISTRICTS AND CERTAIN USAGES.

AND SO LIKE MENTIONED BEFORE, WE WANTED A PERSON, IF YOU LIVE IN A RURAL ZONING DISTRICT, TO BE ABLE TO OPEN THE ORDINANCE AND UNDERSTAND THESE ARE MY USES I CAN DO BY RIGHT GO ACQUIRE MY BUILDING PERMITS AND I'M OKAY.

AND THEN PUTTING IN A SECTION FOR ADMINISTRATIVE PERMITS OF THESE WILL REQUIRE A BIT MORE STAFF REVIEW.

BUT ONCE YOU'VE ACQUIRED THAT PERMIT, FEEL FREE TO APPLY FOR YOUR BUILDING PERMITS AND THEN FOR SPECIAL USE PERMITS, THESE ARE MORE INTENSE USES THAT ARE UNIQUE TO EACH OF THESE ZONING DISTRICTS AS THEY STAND.

AND THOSE ARE GOING TO REQUIRE HEARINGS.

BUT YOU CAN AT LEAST UNDERSTAND THE FULL AVAILABILITY OF USES BY OPENING JUST ONE ARTICLE AS YOU GO THROUGH WITH OUR ZONING ORDINANCE.

AS FAR AS OUR GENERAL PROVISIONS, UH, SOME OF THE ITEMS I'VE MENTIONED HAVE BEEN PULLED OUT OF HERE LIKE YOU'RE UNSIGHTLY, UNSANITARY, UN AND HAZARDOUS ACCUMULATIONS, UH, SOME OF YOUR PARKING REGULATIONS AS THOSE ARE MORE COMMON AND WE WANTED THOSE TO BE EASIER TO FIND FOR DEVELOPERS IN THE PUBLIC.

UH, BUT WE ALSO MADE SOME CHANGES WITHIN HERE FOR ITEMS LIKE ADDITIONAL YARD AND OPEN SPACE REGULATIONS AS WELL AS HEIGHT REGULATIONS.

SO THOSE OPEN SPACE REGULATIONS AND YARD REGULATIONS COULD BE HOW FAR CAN MY EVE OR CORNICE OR ORNAMENTAL FUTURE EXTEND INTO A YARD AS A PART OF MY HOME FOR HEIGHT REGULATIONS, IT COULD BE HOW TALL CAN A HOSPITAL BE? HOW TALL COULD A, A REFRIGERATION, UM, STACK BE FOR UH, AN INDUSTRIAL USAGE THERE? AS YOU CAN SEE, THESE ARE VERY LARGE UH, PORTIONS OF TEXT WHICH BOIL DOWN TO, WITH THIS USAGE OR THIS FEATURE, THIS MANY FEET CORRELATES TO AN EXTENSION OR THE HEIGHT.

AND BECAUSE WE UNDERSTOOD THIS IS WHERE WE GET A LOT OF OUR CONFUSION WITH THE ORDINANCE, WE WANTED TO SIMPLIFY THESE INTO CHARTS OF THESE FEATURES CAN EXTEND THIS FAR, THIS TYPE OF STRUCTURE CAN EXTEND UP TO THIS HEIGHT AS AN ADDITIONAL PROVISION WITHIN OUR ORDINANCE TO MAKE THIS MUCH LESS CONFUSING FOR THE USER.

OUR SPECIAL DEVELOPMENT ZONING, AS I HAD NOTED AT THE BEGINNING IS ONE THAT UNDER UNDERWENT SOME PRETTY SIGNIFICANT CHANGES.

SO YOU'LL SEE IN HERE THERE'S A NUMBER OF PROCESSES THAT COME IN FRONT OF OUR COMMISSION AND BOARD THROUGH SPECIAL DEVELOPMENT ZONING.

THIS IS OUR PLANNED UNIT DEVELOPMENTS.

UM, YOU JUST HEARD AN ITEM ON A MASTER DEVELOPMENT PLAN AMENDMENT, WHICH WAS UNDER THE SPECIAL DEVELOPMENT ZONING WITHIN THIS PORTION OF THE ORDINANCE.

IT ONLY COVERS SITE PLAN REVIEW.

HOWEVER, HOWEVER, ITEMS THAT COME IN FRONT OF THE COMMISSION AND THE BOARD OF SUPERVISORS CAN INCLUDE SITE PLAN REVIEW.

THEY CAN INCLUDE MASTER DEVELOPMENT PLANS IN THEIR AMENDMENTS, TENTATIVE PLATS AND FINAL PLATS.

THE COUNTY'S BEEN DOING THESE FOR OVER 40 YEARS UTILIZING THE SPECIAL DEVELOPMENT ZONING.

BUT WE HAVE NOT BEEN VERY GOOD ABOUT INDICATING WHEN THOSE PROCESSES QUALIFY.

AND WHAT WE EXPECT AS A PART OF SUBMITTALS FOR THOSE PROCESSES, UM, WOULD'VE NOTED FOR THIS FOR FIRST TIME DEVELOPERS IS IT'S AKIN TO A SECRET MENU AT A RESTAURANT OF HERE'S THE ONE ITEM WE'RE GONNA TELL YOU ABOUT.

WE HAVE SOME REALLY AWESOME OTHER ITEMS FOR YOU, BUT YOU HAVE TO ASK, WE DON'T FEEL THAT THAT'S APPROPRIATE FOR DEVELOPERS.

COME ON IN AND OUT'S GREAT MAN.

THEY HAVE A LOT OF HIDDEN, HIDDEN IN .

IT ABSOLUTELY IS AND THAT THAT'S WHAT WE THOUGHT OF IMMEDIATELY WITH THIS IS THAT IS GREAT FOR IN AND OUT.

IT'S NOT GREAT FOR GOVERNMENT BUSINESS UNFORTUNATELY.

UM, SO WE WANTED TO GO THROUGH AND ADD WHAT TYPES OF SPECIAL DEVELOPMENT.

UH, YOU COULD SEE WHAT PROCESSES EXIST WHERE YOU MAY QUALIFY FOR THOSE PROCESSES AND THEN LINKS TO VERY SIMPLIFIED CHECKLISTS THAT WILL ENSURE THERE'S NOT A LOT OF BACK AND FORTH WITH PLAN REVIEW.

THAT DEVELOPERS HAVE VERY CLEAR EXPECTATIONS UPFRONT OF WHAT SHOULD BE SUBMITTED IN ORDER TO MOVE FORWARD WITH SPECIAL DEVELOPMENT ZONING PROCESSES FOR OUR PARKING BEFORE, SIMILAR TO YOUR ADDITIONAL YARD, UH, REGULATIONS AS WELL AS HEIGHT.

THESE ARE HUGE BLOCKS OF TEXTS THAT EXIST TO EFFECTIVELY SAY FOR THIS MANY SQUARE FOOTAGE OF BUILDING, YOU HAVE THIS MANY PARKING SPACES THAT ARE GOING TO BE REQUIRED.

ANOTHER ISSUE WE HAD WAS INCONSISTENCY WITH THE RESIDENTIAL AND BUILDING CODES THAT ARE UTILIZED BY OUR BUILDING DIVISION.

SOME OF OUR PARKING WAS IN EXCESS, SOME OF IT WAS BELOW WHAT WE HAD WITH THOSE BUILDING CODES.

UM, AND THEN OFTEN OFTENTIMES YOU'LL HAVE DEVELOPERS ARE MORE USED TO USING A ZONING ORDINANCE, WHEREAS SOME OF OUR LOCAL CONTRACTORS ARE GONNA BE MORE USED TO USING THE BUILDING CODE.

AND WE WANTED THE EXPERIENCE THAT IF YOU'RE USED TO ONE OR THE OTHER, IF YOU OPEN ONE OF THOSE DOCUMENTS, YOU SHOULD BE ABLE TO GET TO THE SAME RESULT.

OTHERWISE WE HAD CASES WHERE ONE EXCEEDED THE OTHER, THEY HAD FOLLOWED THE OTHER DOCUMENT WITH THE LOWER LEVEL AND THEY WOULD'VE TO COME BACK AND AMEND PLANS, WHICH IS VERY FRUSTRATING WHERE THEY FEEL THERE SHOULD BE CONSISTENCY BETWEEN THE TWO DOCUMENTS THAT WE'VE ADOPTED TO GOVERN OUR BUILDING WITHIN THE COUNTY.

SO WE HAVE SIMPLIFIED THAT WITHIN A CHART AND WE HAVE MADE THOSE STANDARDS CONSISTENT WITH THE BUILDING AND RESIDENTIAL CODES AS WELL SO THAT IF YOU OPEN EITHER DOCUMENT AND YOU'RE ONLY FAMILIAR WITH ONE, YOU'RE GOING TO GET THE SAME RESULT AS SOMEONE WHO IS FAMILIAR WITH THE OTHER.

AS FAR AS OUR CHANGES TO SIGNS, UH, OF COURSE THE MOST VISUAL ASPECT OF OUR ORDINANCE IS THE HARDEST TO VISUALIZE HERE ON A SCREEN.

UM, BUT FOR THE BOARD WE WANTED TO NOTE THAT WE HAD AMENDED THIS TO BRING IT INTO COMPLIANCE WITH THE CASE REED VERSUS THE TOWN OF GILBERT.

UM, THAT CASE ENDED UP GOING TO THE SUPREME COURT AND EFFECTIVELY THE DECISION SAID THAT ALL SIGNS NEEDED TO REMAIN CONTENT NEUTRAL AS FAR AS SIGN REGULATIONS, OTHERWISE IT COULD BE SEEN AS A VIOLATION OF THE FIRST AMENDMENT.

AND SO WHAT YOU WOULD FIND WITHIN OUR

ORDINANCE WHERE IT MAY OR MAY NOT HAVE BEEN A VIOLATION AND WE WANTED TO CLEAN UP THAT LANGUAGE WOULD BE ITEMS LIKE TEMPORARY REAL ESTATE SIGNS VERSUS TEMPORARY CONSTRUCTION SIGNS VERSUS TEMPORARY EVENT SIGNS.

SO WE'VE MADE ALL LANGUAGE WITHIN THEIR CONTENT NEUTRAL.

SO WE JUST HAVE HAVE SECTIONS FOR TEMPORARY SIGNS, PERMANENT SIGNS, SIGNS THAT DO NOT REQUIRE PERMITS TO ENSURE THAT WE'RE IN COMPLIANCE AND WE DON'T HAVE ANY LEGAL CHALLENGES WHERE IT'S SEEN AS VIOLATING THE FIRST AMENDMENT RIGHTS OF OUR CITIZENS OR DEVELOPERS.

I WANT TO CHECK IN 'CAUSE WE'RE ABOUT TO GO INTO THIS PIECE AND THAT'S GREAT.

IF WE'RE OVERWHELMED AS STAFF AND WE WORK WITH IT DAILY, THEY'RE CERTAINLY OVERWHELMED WHEN IT'S THEIR FIRST EXPERIENCE AND WE WANTED TO REMOVE THAT BARRIER FOR THE PUBLIC, RIGHT.

THE NEXT PORTION THAT WE HAVE IS OUR RENEWABLE ENERGY.

I KNOW THE BOARD IS AWARE OF THIS.

THIS HAS BEEN A TOPIC, UH, THAT'S COME FROM THE PUBLIC FOR THE PAST 12 MONTHS.

THIS HAS BEEN SOMETHING THAT'S BEEN ACTIVELY WORKED UPON FOR THE PAST SIX MONTHS IN AN OFFICIAL CAPACITY SINCE THE ADOPTION OF THE COMPREHENSIVE PLAN.

UM, SO WE DID WANT TO GIVE SOME, SOME SPECIAL EMPHASIS TO THIS BECAUSE WE UNDERSTAND THAT, UH, IT, IT IS IMPORTANT TO OUR PUBLIC, UH, FOR THE BOARD.

I KNOW YOU'VE SEEN SLIDES SIMILAR TO THIS, BUT WE WANTED TO POINT OUT OUR CURRENT WIND ENERGY ORDINANCE AND COMPONENTS THAT ARE CONTAINED WITHIN THAT ORDINANCE.

UM, SO THEY'RE PRETTY SIGNIFICANT.

YOUR ITEMS LIKE ROADWAYS, DECOMMISSIONING, NOISE REQUIREMENTS, SETBACKS WITH WHAT WE'VE PROPOSED, AND I'LL TOUCH ON IT IN THE NEXT SLIDE.

WE HAVE COMBINED AN ADDED SOLAR DEVELOPMENT AND CREATED A RENEWABLE ENERGY DEVELOPMENT PORTION OF THE ORDINANCE SO THAT THERE ARE CLEAR STANDARDS FOR DEVELOPERS AND CLEAR STANDARDS THAT THE PUBLIC IS ALSO ABLE TO UNDERSTAND.

ANYTHING WITH WITHIN THIS SLIDE THAT CAN BE APPLICABLE TO SOLAR HAS BEEN ADDED TO SOLAR.

UM, SO YOU'RE NOT GONNA SEE ITEMS LIKE NOISE REQUIREMENTS.

THEY'RE, THEY'RE NOT MAKING THE NOISE LIKE YOU WOULD SEE WITH TURBINES, BUT YOU ARE SEEING ITEMS LIKE THE DECOMMISSIONING PLAN.

THE DECOMMISSIONING BONDS ARE ROADWAYS THAT ARE EXISTING, THE ROADWAY USE AGREEMENTS.

SO ANYTHING THAT I TALK ABOUT FROM THIS POINT ONWARD ARE ITEMS THAT HAVE BEEN ADDED EITHER TO BOTH WIND AND SOLAR OR JUST WIND OR SOLAR.

THESE ITEMS WILL STILL EXIST AND BE ADDED TO SOLAR THEMSELVES AS WELL.

AS FAR AS THE PROPOSED UPDATES I JUST MENTIONED, THAT WOULD BE COMBINING THE GENERAL DEVELOPMENT STANDARDS FOR THESE.

UH, AND SO THESE ARE APPLICABLE TO BOTH WIND AND SOLAR, THIS ENTIRE SLIDE.

SO WE HAVE ADDED A CLAUSE TO ALLOW FOR THESE DEVELOPMENT AGREEMENTS IN LIEU OF, OR COMBINATION WITH SPECIAL USE PERMITS.

WE'VE ADDED IN PREFERRED CRITERIA AND PERFORMANCE STANDARDS FOR RENEWABLE PROJECTS WHERE THERE COULD BE PREFERRED OR DIS PREFERRED PROJECTS WITH THE BOARD OF SUPERVISORS BASED ON STANDARDS SUCH AS RECLAIMED LAND.

THOSE WITH LOWER VISUAL IMPACT, THOSE THAT WOULD UTILIZE RECLAIMED WATER.

SO PROJECTS WHERE THEY COULD HAVE LESS OF AN IMPACT POTENTIALLY ON THE COMMUNITY WOULD HAVE PREFERRED STANDARDS WITHIN THE ORDINANCE.

WE ALSO ADDED STRONGER LANGUAGE FOR FIRE, CLARIFYING THEIR AUTHORITY WITH APPLICATION REVIEW, PERMITTING, INSPECTIONS, POST-ACCIDENT AND DECOMMISSIONING AS A PART OF UPDATING THIS LANGUAGE FOR FIRE.

THE COUNTY DID HOST A LISTENING SESSION WITH ALL OF THE, UH, FIRE CHIEFS AND FIRE MARSHALS WITHIN THE REGION HERE, UM, TO HEAR THEIR CONCERNS.

THE MAIN CONCERN WE HEARD FROM FIRE WAS ALTHOUGH WE HAD STANDARDS TO ALLOW FIRE TO, TO MAKE REQUESTS AND TO HAVE AUTHORITY WITHIN THESE, THEY DID NOT FEEL EMPOWERED AT THAT POINT IN TIME.

UM, BASED ON THAT WE HOSTED ANOTHER TWO ADDITIONAL MEETINGS, I BELIEVE WITH SOME OF THOSE FIRE CHIEFS AND FIRE MARSHALS AND DISCUSSED WHAT LANGUAGE COULD MAKE THEM FEEL MORE EMPOWERED, MORE AS PARTNERS WITH THE COUNTY WHEN IT CAME TO THESE PROJECTS.

AS A RESULT

OF THAT, WE PREPARED OUR LANGUAGE, WHICH WE THEN RAN BY THOSE FIRE CHIEFS AND FIRE MARSHALS AND THEY ARE COMFORTABLE WITH THE LANGUAGE.

THEY DO FEEL EMPOWERED AND THEY FEEL LIKE MORE OF A PARTNER MOVING FORWARD WITH THE COUNTY BASED ON WHAT'S BEEN CONTAINED WITHIN THE ORDINANCE.

WE ALSO ADDED IN A CLAUSE TO STRENGTHEN ROAD USE AGREEMENTS FOR DURATION OF PROJECT CONSTRUCTION AS WELL AS POST CONSTRUCTION.

UM, SO CURRENTLY WITH PROJECTS, WHAT WE HAVE ON SPECIAL USE PERMITS IS A CONDITION OF THE ROADWAYS IS TAKEN AT THE BEGINNING OF THE PROJECT.

A CONDITION OF THE ROADWAYS IS RECORDED AT THE END OF THE PROJECT AND A DEVELOPER IS RESPONSIBLE TO IMPROVE THE ROADWAY AT LEAST BACK TO THE INITIAL CONDITION.

WHEN IT COMES TO THE TRUCKS THAT ARE HAULING IN THIS EQUIPMENT, THERE IS THE POTENTIAL FOR THEM TO CREATE POTHOLES OR CRACKING IN THE ROADWAYS DURING THE DURATION, WHICH CAN BE, UH, A NEGATIVE FOR OUR CITIZENS, BUT IT CAN ALSO BE A NEGATIVE FOR THE DEVELOPER.

WHAT WE'VE FOUND OVER THE PROJECTS THAT WE'VE HAD HERE WITHIN THE COUNTY IS THESE DEVELOPERS ARE MORE THAN WILLING TO WORK WITH US AS FAR AS MAINTENANCE AND, AND KEEPING UP THOSE ROADWAYS AS A RESULT OF THE DAMAGE THAT THAT MAY BE INCURRED ON OUR ROADS IN VERY FAST FASHION.

UM, BUT WE WANTED TO PREPARE THIS ORDINANCE FOR THE WORST CASE SCENARIO WHERE A DEVELOPER MIGHT NOT BE WILLING TO DO THAT AND ADD IN THOSE PROTECTIONS HERE.

UM, SO IT HASN'T BEEN AN AREA OF CONCERN OF THIS NOT OCCURRING, BUT WE DID WANT TO HAVE THOSE PROTECTIONS PUT IN PLACE FOR THE COUNTY MOVING FORWARD.

WE DID ADD REQUIREMENTS FOR APPLICANTS TO CONSULT WITH MUNICIPALITIES AND TRIBAL ENTITIES WITHIN FIVE MILES OF PROPOSED PROJECT BOUNDARIES.

WHAT WE HEARD THROUGHOUT SOME OF OUR LISTENING SESSIONS, WORK SESSIONS AND JUST GENERAL COMMENTS FROM THE PUBLIC WAS THEY WANTED TO BE MORE INFORMED OFTEN WITH THESE PROJECTS, AND THAT MUNICIPALITIES WANTED TO BE AWARE OF THESE PROJECTS AS WELL AND HAVE A CHANCE TO SPEAK WITH THESE DEVELOPERS.

UH, I WILL, FOLLOWING THIS, GO INTO SOME OF THE COMMENTS.

WE DID RECEIVE A COMMENT REGARDING SOME OF THE VERBIAGE RELATING TO MUNICIPALITIES AND TRIBAL ENTITIES, AND I WILL JUST KIND OF WALK THROUGH WITH THE BOARD OF, OF WHERE WE FEEL THERE MAY BE A, A SLIGHT UPDATE THAT'S APPROPRIATE THERE.

WE ALSO INCLUDED, UH, CODIFYING THE MANDATE OF THE USE OF BEST AVAILABLE COMMERCIALLY PROVEN TECHNOLOGY TO MINIMIZE WILDLIFE IMPACTS.

THIS, THIS CLAUSE HERE ALSO COVERS FOR ITEMS LIKE FIRE WHEN YOU'RE LOOKING AT BATTERY STORAGE.

UM, SO A COMMENT WE RECEIVED FROM COMMISSIONERS AND THE PUBLIC WAS POTENTIALLY LOOKING AT DO WE MANDATE A, A MINIMUM LEVEL OF WHAT IS REQUIRED IN THESE PROJECTS.

SO LIKE A MINIMUM TURBINE DESIGN, UM, MINIMUM PANEL DESIGNS, MINIMUM BATTERY STORAGE DESIGNS.

WHAT WE FOUND IS THESE PROJECTS IN THIS INDUSTRY DEVELOPS AT SUCH A RAPID PACE THAT IF YOU'RE SETTING THOSE MINIMUMS WITHIN YOUR DEVELOPMENT STANDARDS, YOU COULD BE DOING A DISSERVICE TO THE PUBLIC BECAUSE THERE COULD BE SOMETHING WITHIN A COUPLE YEARS THAT IS UPDATED AND IS SAFER FOR THE ENVIRONMENT.

IS SAFER FOR OUR PUBLIC, SAFER FOR FIRE.

AND SO WE WANTED TO CODIFY AND KEEP THAT ON A ROLLING BASIS, THAT WE TAKE THE BEST COMMERCIALLY PROVEN.

SO WE'RE NOT TAKING PROTOTYPES WITHIN THE COUNTY, EITHER THOSE THAT ARE ACTUALLY MANUFACTURED, BUT WE'RE TAKING THE BEST TECHNOLOGY AS IT MOVES FORWARD.

SO WE DON'T SET OURSELVES BACK WITHOUT DATA TECHNOLOGY WITHIN THE BOUNDARIES OF THE COUNTY.

WE ALSO HAD CODIFIED A MANDATE FOR SITE STUDIES SUCH AS ENVIRONMENTAL, CULTURAL, WETLAND AND PHOTO SIMULATIONS.

THESE ARE EXPECTATIONS THAT WE HAVE OF PROJECTS CURRENTLY AND SUBMITTALS THAT WE HAVE.

UM, BUT WE WANTED THAT CODIFIED AND I, WE DID RECEIVE A, A COMMENT REGARDING TWO MINOR COMPONENTS OF THAT THAT I WILL TOUCH ON IN JUST A MOMENT AS WELL.

AS FAR AS PROPOSED UPDATES TO THE WIND SPECIFIC AND SOLELY WIND, THERE WERE WAIVERS TO BE ACCEPTED FROM NON-PARTICIPATING ADJOINING PROPERTIES WITHIN REQUIRED SETBACK BOUNDARIES.

UH, THIS HAD COME UP FROM CITIZENS AS WELL AS SUPERVISORS AND COMMISSIONERS THAT IF A PROPERTY IS WITHIN A SETBACK BOUNDARY OR A, A BOUNDARY OF NOISE, THAT THEY, IF THEY FEEL THAT THEY WOULD LIKE TO GRANT A WAIVER, WHETHER THAT'S SOMETHING WHERE THEY'VE BEEN MONETARILY, UM, GIVEN SOME COMPENSATION OR OTHER FORM OF AGREEMENT WITH THIS, THAT THEY HAVE THAT RIGHT TO DO SO, PROVIDED THEY PROVIDE A WAIVER TO THE COUNTY NOTIFYING THAT THEY'RE AWARE OF, OF WHAT THEY'RE DOING WITH THAT WAIVER, UM, AND THAT THEY HAVE COME TO THEIR OWN AGREEMENT WITH THE DEVELOPER.

UM, SO NOT TAKING AWAY OUR CITIZENS' RIGHTS TO NEGOTIATE FOR THEMSELVES WHEN IT RELATES TO THESE PROJECTS.

THEN FOR THE SOLAR SPECIFIC, WE HAD ADDED IN THE SETBACK AND DEVELOPMENT STANDARDS MUST COMPLY WITH THE ZONING DISTRICT IN WHICH IT'S LOCATED, AGAIN, WAIVERS, BUT THOSE WAIVERS BEING SPECIFIC TO SOLAR SETBACKS AND A PROVISION FOR SCREENING ADJACENT TO RESIDENTIAL DEVELOPMENTS.

I'LL GET INTO OUR RECOMMENDATION IN JUST A MOMENT HERE, BUT I WANTED TO WALK THROUGH THE COMMENTS THAT WE RECEIVED AS OUR STAFF, AS WELL AS THE COUNTY THROUGHOUT THIS PROCESS AND SOME OF THE STAFF ANALYSIS WITH THOSE COMMENTS SO THAT THE BOARD IS AWARE, UM, THAT WE HAVE READ THROUGH AND WE'RE WE'RE ADDRESSING THOSE AS AS APPROPRIATE.

UM, SO WE DID RECEIVE 21 COMMENTS AS OPPOSED OUR STAFF REPORT FOR

THIS PROJECT.

ALL OF THOSE WERE RELATED TO RENEWABLE ENERGY.

NONE OF THOSE WERE RELATED TO THE REMAINDER OF THE ORDINANCE AS IT EXISTS.

THOSE 21 COMMENTS ALL CAME IN PRIOR TO THE DEVELOPMENT OF THIS ORDINANCE.

SO THEY WERE CONSIDERED ASPRO AS APPROPRIATE AND INCORPORATED AS APPROPRIATE AS A PART OF THIS ORDINANCE.

IN ADDITION, DURING THE UPDATE PROCESS, THE FOLLOWING COMMENTS WERE RECEIVED BY COUNTY ADMINISTRATION AND WERE ALSO CONSIDERED WHEN DEVELOPING THIS ORDINANCE.

UM, SO THE COUNTY HAD 51 JOT FORM SUBMISSIONS ONLINE, FIVE LETTERS AND EMAILS, 28 COMMENTS AT OUR SHOW, LOW LISTENING SESSION 31 AT OUR HEBER LISTENING SESSION 27 AT THE JOSEPH CITY LISTENING SESSION.

AND THEN THROUGH THE, THE COUNTY MANAGER'S OFFICE, THEY DID CREATE A SUMMARY OF THIS, WHICH HAS BEEN INCLUDED IN A PACKET FOR ALL OF THE SUPERVISORS AS FAR AS THOSE TESTIMONIES THAT WERE RECEIVED FROM THE PUBLIC.

SINCE POSTING OUR STAFF REPORT, WE'VE RECEIVED AN ADDITIONAL FURTHER SEVEN COMMENTS ON THE DRAFT ORDINANCE.

UM, THOSE HAVE BEEN PRINTED OFF AND SUPPLIED TO THE SUPERVISORS AS WELL, AND WERE SUPPLIED TO OUR COMMISSIONERS LAST THURSDAY.

THOSE COMMENTS, THEY INCLUDED FEEDBACK ON, UM, BUT ARE NOT LIMITED TO.

UM, SO IF YOU HAVE FURTHER COMMENTS, THE BIG ONES THAT WE COULD SEE THAT WE WANTED TO ADDRESS IN SOME WAY, SHAPE, OR FORM WERE CLARIFYING LANGUAGE WITHIN THE ORDINANCE.

NOISE STANDARDS FOR WIND ENERGY, SETBACKS FOR WIND ENERGY, AND THE FEELING THAT THOSE WERE TOO LARGE, EXCESSIVE PUBLIC OUTREACH STANDARDS, DECOMMISSIONING TIMING, UH, ROLL OF FIRE WITHIN REVIEW, AND THEN TRANSFERENCE OF SPECIAL USE PERMITS REQUIRING HEARINGS WITH THE BOARD OF SUPERVISORS FOR RENEWABLE ENERGY.

JUST TO REMIND THE BOARD OF SUPERVISORS ON THESE, OF SOME OF THE ITEMS THAT HAVE NOT NECESSARILY BEEN ADDRESSED, NOISE STANDARDS HAVE NOT BEEN PROPOSED TO BE UPDATED, UH, WE DID NOT RECEIVE ANY COMMENTS OVER THE PAST SIX TO 12 MONTHS REGARDING LOWERING THOSE NOISE STANDARDS OR ALTERING THOSE.

THOSE HAVE COME WITHIN THE PAST WEEK TO WEEK AND A HALF, AND THOSE HAVE BEEN IN PLACE SINCE THE WIND ENERGY ORDINANCE WAS FIRST ADOPTED.

UM, THAT WAS NOT AN ITEM LOOKED AT WITH THIS UPDATE.

SETBACK STANDARDS HAVE ALSO NOT BEEN PROPOSED TO BE UPDATED.

THIS IS SOMETHING THAT WE LOOKED AT AS A PART OF THIS ORDINANCE AND WHAT THE COUNTY HAD LOOKED AT WAS TRYING TO BALANCE THE SETBACK STANDARDS THAT EXISTED.

WE HAD CITIZENS ASKING FOR ANYWHERE FROM SIX TO 50 MILES OF SETBACKS FOR THIS, AND WE HAVE DEVELOPERS THAT HAVE ASKED FOR REDUCTIONS IN SETBACKS THAT WOULD BE BASED ON THE HEIGHT OF TOWERS VERSUS OUR QUARTER VERSUS HALF MILE SETBACKS THAT EXIST.

UM, THERE WAS CONCERN FROM CERTAIN GROUPS THAT THEY FELT THE EXISTING SETBACK STANDARDS MAY LIMIT WIND ENERGY DEVELOPMENT TO A POINT WHERE IT'S NOT VIABLE.

I WOULD JUST REMIND THE BOARD OF SUPERVISORS THAT WE HAVE THREE PROJECTS THAT ARE EITHER CONSTRUCTED OR UNDER CONSTRUCTION RELATED TO WIND ENERGY.

SO IT IS CERTAINLY POSSIBLE TO DEVELOP WIND WITHIN NAVAJO COUNTY WITH THE STANDARDS THAT EXIST, WHICH HAVE ALSO BEEN THERE SINCE THE INCEPTION OF THE ORDINANCE.

PUBLIC OUTREACH WAS A COMMON THEME OF COMMENTS THAT WE RECEIVED THAT THE PUBLIC WANTED MORE NOTIFICATION IN THE PROCESS AND THEY WANTED MORE NOTIFICATION EARLY.

THE STANDARDS UTILIZED AND ADDED TO SOLAR ENERGY ARE STANDARDS THAT HAVE EXISTED SINCE THE BEGINNING OF OUR WIND ENERGY ORDINANCE.

SO WE FELT IT FAIR AND APPROPRIATE THAT THOSE STANDARDS WOULD REMAIN THE SAME FOR BOTH TYPES OF DEVELOPMENT BASED ON FEEDBACK FROM THE PUBLIC THAT THEY WOULD LIKE TO BE INFORMED OF THESE PROJECTS.

UH, WE UNDERSTAND THAT THAT CAN CREATE MORE WORK FOR DEVELOPERS, BUT A LARGE AMOUNT OF OUR FEEDBACK IS THAT PUBLIC WANTS TRANSPARENCY WITH THESE PROJECTS, AND THAT IS A WAY THAT WE CAN ACHIEVE FURTHER TRANSPARENCY AS THOSE MOVE FORWARD.

UH, WITH DECOMMISSIONING FOR WIND, IT HAS ALWAYS BEEN REQUIRED PRIOR TO CONSTRUCTION AND MAKING OUR STANDARDS UNIFORM BASED ON CONCERNS FOR THE WELFARE AND SAFETY OF THE PUBLIC AND THE SAFETY ON THE FIDUCIARY SIDE.

WE HAVE INCLUDED THOSE STANDARDS THAT SOLAR WOULD ALSO BE REQUIRED TO DO THEIR BONDING UPFRONT VERSUS DEFERRED BONDING FURTHER WITHIN THE TERM OF THE PROJECT ITSELF.

UM, WE UNDERSTAND THAT THAT COULD INCUR A GREATER COST, BUT THERE WAS CONCERN OVER WHETHER WE HAD APPROPRIATE BONDING AND THAT THOSE BONDS COULD REMAIN IN PLACE THROUGHOUT THE DURATION OF PROJECTS FOR FIRE JURISDICTIONS.

THEY SPECIFICALLY REQUESTED MORE CLARITY IN THEIR ROLE FOR REVIEW, AS I NOTED, WE HELD A LISTENING SESSION WITH THOSE FIRE CHIEFS AS WELL AS SOME FOLLOW UP MEETINGS.

THEY WANTED ASSURANCES THAT THEY COULD REQUIRE INFRASTRUCTURE IMPROVEMENTS NECESSITATED BY FOR PUBLIC SAFETY.

UM, SO WHAT WE HAVE WITH THESE PROJECTS IS THEY'RE TYPICALLY WITHIN THE FIRE MARSHAL'S JURISDICTION FOR REVIEW THE STATE FIRE MARSHAL.

UM, SO THEY'RE GOING THROUGH REVIEWING TO THEIR ADOPTED FIRE CODE FOR WHAT IS NEEDED ON THE INFRASTRUCTURE SIDE AS A MINIMUM, AND THEN WE HAVE RESPONDING AGENCIES BECAUSE WE DO NOT HAVE A RESPONDING AGENCY WITH THE STATE FIRE MARSHAL'S OFFICE.

UM, OUR THREE MOST COMMON ARE JOSEPH CITY, TAYLOR SNOWFLAKE, HEBREW OVER GUARD HERE.

UM, THEY'RE THE ONES RESPONDING AND THEY'RE AWARE OF WHAT'S ACTUALLY PHYSICALLY ON THE GROUND FOR THESE PROJECTS, AND THEY INCLUDED SOME SPECIFIC EXAMPLES THAT THEY SAW AND THEY JUST WANTED TO FEEL EMPOWERED TO ASK FOR THESE.

THEY'RE NOT TRYING TO GO ABOVE AND BEYOND AND

ASK FOR THE MOON.

THEY WANNA MAKE SURE THAT THEY AND THE PUBLIC ARE SAFE.

SO ITEMS SUCH AS HAVING CATTLE GUARDS WHERE NEEDED VERSUS GATES THAT CAN INCREASE THEIR RESPONSE TIMES, MAKING SURE THERE'S APPROPRIATE ROAD WIDTH AND MATERIAL WHILE THAT'S THERE WITHIN THE FIRE CODE REVIEWED BY THE FIRE MARSHAL, THEY WANT TO MAKE SURE THAT ONSITE THIS ACTUALLY MAKES SENSE FOR THE EQUIPMENT THAT THEY HAVE EMPLOYED WITH THEIR AGENCIES AND THEN ALSO TURNING RADIO WHERE NECESSARY THEY DO NOT WANT TO BACK THEIR FIRE TRUCKS TWO MILES OUT OF A SITE.

THEY'D LIKE TO BE ABLE TO TURN AROUND, UM, BETTER FOR THEIR SAFETY AND TIMING AS WELL AS THEY COMBAT ANY POTENTIAL EMERGENCIES.

ALSO, DENOTE TRANSFERENCE OF A SPECIAL USE PERMIT REQUIRING A HEARING WITH THE BOARD OF SUPERVISORS HAS ALWAYS BEEN A REQUIREMENT FOR WIND ENERGY.

THIS ADDITION WAS SOLELY BROUGHT TO SOLAR TO ADD TO THOSE STANDARDS AND BRING THEM TO THE SAME STANDARDS.

UM, THIS IS AN ITEM THAT CAN BE APPLIED TO ANY SPECIAL USE PERMIT, HAS ALWAYS BEEN ABLE TO BE APPLIED TO ANY SPECIAL USE PERMIT.

BUT WHEN THE FIRST ORDINANCE WAS ADOPTED, THE BOARD ENSURED THAT THAT WAS SPECIFICALLY CALLED OUT SO THAT DEVELOPERS WERE AWARE.

UH, AS I HAD NOTED ON THE ONE COMMENT, THOSE ABOVE COMMENTS WERE NOT HEARD DURING EXTENSIVE OUTREACH, UH, IN THE UPDATING OF THIS PORTION OF THE ORDINANCE.

WE UNDERSTAND SOME OF THOSE MAY NOT HAVE BEEN HEARD AS WE WERE DEVELOPING SOME OF THESE STANDARDS, SO THAT IS UNDERSTANDABLE.

UM, BUT THOSE ALL DID COME IN RATHER RECENTLY HERE TO OUR STAFF.

IN THE REVIEW OF COMMENTS.

STAFF DOES BELIEVE THAT THE FOLLOWING UPDATES COULD BETTER CLARIFY SOME LANGUAGE, BUT THEY WOULD NOT ALTER THE INTENT OF THE ORDINANCE.

UM, THAT WAS NOT OUR INTENT.

WE CANNOT PUSH THAT PROCESS FORWARD.

WE DO WANT TO SEE COORDINATION WITH THE THESE ENTITIES STILL AND FEEL IT'S IMPORTANT, BUT FOR CLARITY, WE DO NOT WANT TO CONFUSE DEVELOPERS OR THE PUBLIC THINKING THAT WE ARE OVEREXTENDING BEYOND THE AUTHORITY THAT WE HAVE HERE AS A COUNTY.

AFTER REVIEW STAFF DOES NOT FEEL THAT FURTHER EDITS OF THE ORDINANCE WOULD BE APPROPRIATE OUTSIDE OF THOSE JUST NOTED.

AND JUST FOR SOME POINTS OF CLARITY, THERE WERE SOME MINOR POINTS, UH, KIND OF WANTING TO UNDERSTAND SOME, SOME LANGUAGE AND HOW THAT MIGHT APPLY TO THIS.

UH, ONE OF THESE WAS THAT SOLAR PANELS DO NOT COUNT AS IMPERVIOUS SURFACES.

THEY DO NOT COMPLETELY COVER THE GROUND.

THEY ALLOW FOR RUNOFF.

UM, SO THEY WOULD NOT BE CONSIDERED IN THE SAME WAY AS A BUILDING WHEN IT COMES TO LOT COVERAGE.

AND THEN LARGER FENCING HEIGHTS WERE BEING ALLOWED THEN IN RESIDENTIAL AREAS, EIGHT FEET VERSUS SEVEN FEET.

THIS WOULD BE TYPICAL FOR A PROJECT OF COMMERCIAL OR INDUSTRIAL NATURE.

AND AS THIS PORTION OF THE ORDINANCE IS MORE SPECIFIC TO RENEWABLE ENERGY, UH, THOSE PROVISIONS WOULD END UP PREVAILING ON THIS.

SO WE DO HAVE DIFFERENT STANDARDS FOR OUR RESIDENTIAL MAXIMUMS VERSUS COMMERCIAL AND INDUSTRIAL.

THE COUNTY HAS ALWAYS HAD THAT, BUT WE JUST WANTED TO POINT OUT THAT WAS NOT AN OVERSIGHT.

WE DID NOT MISS THAT AS A PORTION OF THIS.

GIVEN EVERYTHING CONSIDERED AND WHAT I'VE PRESENTED HERE TO YOU TODAY, NAVAJO COUNTY PLANNING DEVELOPMENT SERVICES STAFF IS RECOMMENDING APPROVAL OF THE UPDATE TO THE NAVAJO COUNTY ZONING ORDINANCE LAST THURSDAY AT THE NAVAJO COUNTY PLANNING AND ZONING COMMISSION.

BUT I THINK THIS ONE IS GOOD 'CAUSE IT'S, UH, YOU KNOW, IT, IT IS CLEAN, IT DOESN'T CONTRIBUTE TO AIR POLLUTION, DOESN'T CONTRIBUTE TO WATER POLLUTION.

UM, AND I THINK, UH, IT'S A PRETTY VIABLE INDUSTRY NOWADAYS.

SO I THINK THE PROJECTS GET DONE, YOU KNOW, MORE OFTEN THAN NOT ON TIME AND ON BUDGET.

UM, WHICH I THINK IS IMPORTANT FOR THE, UH, COUNTY'S, UH, ECONOMIC DIVERSIFICATION.

UM, OF COURSE IT'S NOT SOMETHING THAT'S GONNA SOLVE ALL OF THE, THE ECONOMIC AND FINANCIAL NEEDS IN THE COUNTY, BUT I THINK IT'S SOMETHING THAT CONTRIBUTES A FAIR AMOUNT TO THAT.

UM, SO IT IS, UH, I THINK THERE'S PARTS OF IT THAT ARE PRETTY TOUGH ON DEVELOPMENT, UM, BUT I UNDERSTAND THAT'S SOMETHING THAT THE PUBLIC'S ASKING FOR.

SO, UM, AND I GUESS, UH, THAT'S, UH, PRETTY MUCH IT, BUT THANK YOU FOR, UH, GIVING ME THE OPPORTUNITY TO SPEAK AND, UH, UH, APPRECIATE YOUR TIME.

I'D LIKE TO THANK THE SUPERVISORS FOR CONSIDERING RENEWABLE ENERGY SOURCES AND FOR LISTENING TO OUR COMMUNITY.

AND MY COMMENTS ARE MORE FROM A PERSONAL PERSPECTIVE AND NOT, UH, ADDRESSING THE ORDINANCE SPECIFICALLY.

BUT MY NAME IS DON FOGEL.

I LIVE IN SHOW LOW.

MY WIFE AND I MOVED HERE FROM PHOENIX 24 YEARS AGO, AND I WAS BORN IN PHOENIX IN 1942.

AND THEY'VE LIVED IN ARIZONA ALL MY LIFE, EXCEPT FOR ONE YEAR IN TEXAS.

I REMEMBER COMING UP TO THE WHITE MOUNTAINS WITH MY FAMILY AS A CHILD IN THE LATE FORTIES AND FIFTIES AND LATER WITH MY WIFE AND OUR FAMILY.

AND I LOVED HOW IT RAINED ALMOST EVERY DAY UP HERE AND IN PHOENIX IN SUMMER, AND HOW IT SNOWED A LOT IN THE WINTERTIME.

YOU COULD COUNT ON IT, EV EVEN SINCE WE'VE LIVED UP HERE, WE'VE SEEN THIS CHANGE A LOT.

I'VE SEEN AND LIVED THROUGH DRAMATIC CHANGES IN CLIMATE AND POLLUTION IN ARIZONA.

THE PHOENIX AREA AND ARIZONA HAVE GOTTEN MUCH HOTTER WITH MORE AIR POLLUTION.

AND INTERESTINGLY, TWO DAYS FROM NOW WILL BE 35 YEARS AGO ON JUNE 26TH, 1990 WAS THE HOTTEST DAY ON RECORD IN PHOENIX.

AND I REMEMBER WALKING OUT TO GET THE MAIL THAT DAY.

I'D NEVER FELT IT SO HOT.

IT WAS 122 DEGREES.

AND WE HAVE, AS YOU ALL KNOW, A SEVERE DROUGHT AND FIRE DANGER IN THIS WINTER WAS THE DRIEST.

SINCE WE'VE LIVED HERE, I'M IN FAVOR OF CLEAN, RENEWABLE ENERGY, NOT DIRTY AND UNSUSTAINABLE ENERGY OF THE PAST.

WE MUST LOOK TO THE FUTURE AND USE NEW CLEAN TECHNOLOGIES.

I'M VERY CONCERNED ABOUT HOW HEALTHY THE CLIMATE AND ENVIRONMENT WILL BE IN THE FUTURE FOR MY CHILDREN AND GRANDCHILDREN AND OTHERS.

AND SOLAR AND WIND ENERGY ARE CLEAN.

THE SOURCE IS FREE.

YOU DON'T HAVE TO MINE IT, DRILL FOR IT OR TRANSPORT IT, IT'S ALREADY HERE.

THEY DON'T CONTRIBUTE TO CLIMATE WARMING.

THEY HAVE MINIMAL IMPACT ON WILDLIFE.

CLIMATE CHANGE IS A MUCH GREATER THREAT TO WILDLIFE THAN WIND ENERGY AND CATS ARE A GREATER THREAT TO BIRDS THAN WIND TURBINES.

UM, DRIVING TO VISIT OUR FAMILY IN TEXAS, WE SEE MANY WIND POWERED TURBINES AND WE'RE IMPRESSED THAT TEXAS HAS MORE TURBINES THAN ANY OTHER STATE, AROUND 20,000.

SOME BENEFITS AND SOME AREAS GROWING CROPS CAN OCCUR UNDER SOLAR PANELS AND AROUND WIND TURBINES.

IT'S AGRI VOLTAIC FARMING.

IT'S CALLED LARGE SCALE RENEWABLE ENERGY PROJECTS CAN BRING TENS OF MILLIONS OF DOLLARS IN LOCAL TAX REVENUE, WHICH CAN HELP SCHOOLS AND LOCAL SERVICES.

THESE PROJECTS CREATE CONSTRUCTION AND PERMANENT JOBS, AND THEY PROVIDE ADDITIONAL INCOME TO FARMERS AND RANCHERS FOR THEIR LAND USE.

NAVAJO COUNTY HAS A LOT OF EXISTING TRANSMISSION INFRASTRUCTURE AS WELL AS APACHE FOR USE WITH SOLAR AND WIND ENERGY DEVELOPMENTS.

AND IT MAKES SENSE TO DO IT UP HERE.

AND A LOT OF MY THOUGHTS ARE ALSO IN RESPONSE TO COMMENTS THAT I'VE HEARD, UM, AGAINST USING SOLAR MONEY ENERGY.

IF SO, IF YOU DON'T, BUT KNOW BY NOW, I SUPPORT RENEWABLE ENERGY AND THANK YOU.

I AM HERE TO, UH, SPEAK IN SUPPORT OF CLEAN AND RENEWABLE ENERGY, SHORT AND SWEET.

UH, MY FAMILY IS, UH, LONGTIME PROPERTY OWNERS BOTH IN PINETOP AND IN SHOW LOW.

I MYSELF ACTUALLY RESIDE IN TUCSON, BUT I SPEND A MAJORITY OF MY TIME UP IN NAVAJO COUNTY IN THOSE AREAS.

UH, AND I WISH TO NOT ONLY HIGHLIGHT, UH, AND, AND TAG ALONG WITH SOME OF THE THINGS THAT HAVE ALREADY BEEN SET IN TERMS OF CLEAN ENERGY BEING A RESPONSIBLE WAY FOR US TO MAINTAIN CLEANER AIR, TO DEAL WITH THE RISING HEAT THAT WE'RE DEALING WITH TO MITIGATE SOME OF OUR DROUGHT ISSUES.

WATER CONSERVATION IS CRUCIAL ACROSS THE ENTIRE STATE, INCLUDING HERE.

UM, BUT I ALSO WISH TO SPEAK ON THE FACT THAT YOU AS ELECTED OFFICIALS ARE NOT ONLY STEWARDS OF YOUR CONSTITUENTS, CONSTITUENTS WANTS AND DESIRES, YOU ARE ALSO STEWARDS OF FACTS AND ACTUAL INFORMATION, NOT MISINFORMATION.

AND YOU ARE STEWARDS OF THE LAND THAT YOUR CONSTITUENTS LIVE ON.

AND SO, IN SHORT, ASSURING THAT WE CAN PROVIDE CLEAN ENERGY, THAT IS PROVIDING CLEAN AIR, CONSERVING OUR WATER, AND FINDING WAYS TO PRESERVE OUR WILDLIFE AND OUR LANDS ARE ONE OF THE MOST IMPORTANT THINGS YOU CAN DO IN YOUR ROLES FOR THE PEOPLE THAT LIVE IN NAVAJO COUNTY.

AND I ENCOURAGE YOU TO CONTINUE TO DO THAT AS YOU CONSIDER THIS ORDINANCE AND ANY FUTURE ORDINANCES THAT COULD POTENTIALLY LIMIT THINGS LIKE RENEWABLE ENERGY THAT COULD BE THE DIFFERENCE BETWEEN NAVAJO COUNTY EXISTING IN 2050, A HUNDRED YEARS, OR ARIZONA, KIND OF GOING UP IN FLAMES AND BEING, UH, OCCUPIABLE, IF YOU WILL.

UM, WELL, I KNOW THAT THIS HAS BEEN A LONG ROAD, AND I THINK THAT THE LONG ROAD, UM, HAS BEEN A BENEFIT TO THE COUNTY IN BEING ABLE TO ENSURE THAT WE, UM, HEARD FROM AS MANY PERSPECTIVES AS POSSIBLE AND THAT WE LOOKED AT, UM, THOSE PARTNERS THAT WERE VALUABLE IN GOING BACK EVEN TO LIKE OUR FIRE DISTRICTS, UM, TO HELP THEM TO BE FEEL INVOLVED AND SO FORTH.

AND, YOU KNOW, WHEN WE LOOK AT THIS, UM, THAT THERE ARE CERTAINLY A LOT OF LAYERS TO THIS AND, UM, RENEWABLE ENERGY IS ONE OF THOSE LAYERS.

BUT INITIALLY, WHEN WE LOOK AT THE,

THE ZONING ORDINANCE ITSELF, UM, AND HOW DO WE HELP THE PUBLIC TO BECOME INFORMED ABOUT HOW DO THEY, UM, IF THEY'RE LOOKING AT DEVELOPING THEIR PROPERTY, IF THEY'RE LOOKING AT, UM, ENHANCING OR PURCHASING PROPERTY AND COMING TO NAVAJO COUNTY, UM, WHAT IS REQUIRED IN ORDER TO BUILD THOSE BUSINESSES, UM, I THINK THAT WE HAVE CREATED, UM, A DOCUMENT THAT DEMONSTRATES TO THOSE POTENTIAL DEVELOPERS SOMETHING THAT IS VERY COMPREHENSIVE AND THAT'S EASY TO UTILIZE.

AND I THINK THAT'S REALLY IMPORTANT.

IF I AM, UH, UM, A LAYMAN TO THESE, TO THE CONTEXT OF HOW TO DO THAT.

UM, TO ME THIS WORKS GREAT, UM, IN BEING ABLE JUST TO LAY OUT WHAT DOES THAT LOOK LIKE, NOT ONLY FROM, UM, THE PROPERTY ITSELF, BUT LOOKING AT PARKING AND SO FORTH, AND ALL OF THOSE STRUCTURES THAT ARE NEEDED TO CREATE A VIABLE SPACE TO BUILD, UM, BUSINESS WITHIN OUR COMMUNITIES.

AND THEN WE LOOK AT THE NEXT STEPS AT RENEWABLE ENERGY, UM, RENEWABLE ENERGY, UM, AND HOW DO WE PARTNER WITH OUR LOCAL COMMUNITY MEMBERS? 'CAUSE THAT'S VERY IMPORTANT WHEN WE CHOOSE TO LIVE IN NAVAJO COUNTY.

UM, THERE IS A REASON WHY WE'RE CHOOSING TO LIVE IN NAVAJO COUNTY AND, UH, THE RURAL NATURE.

UM, BUT WE ALSO WANT TO, UM, WHEN WE'RE MAKING THOSE CHOICES AND WE'RE THINKING ABOUT THE PUBLIC THAT WE'RE TAKING, UM, THEIR CONCERNS, UM, AS AN IMPORTANT PART OF THIS PROCESS AND LEARNING AND CREATING THAT PARTNERSHIP OF UNDERSTANDING.

AND I, I AM SO GRATEFUL THAT ALL OF YOU HAVE TAKEN THAT TIME TO BE ABLE TO CREATE THAT UNDERSTANDING AND CREATING A CONTEXT THAT WORKS, UM, FOR INDUSTRY AND FOR THE ORGANIZATION OF NAVAJO COUNTY ITSELF.

AND THEN LOOKING AT THOSE POTENTIAL, UM, LAND OWNERS AROUND THE AREAS.

SO THERE'S, THERE ARE SO MANY PARAMETERS TO THAT.

AND ONE OF THE THINGS THAT I HEARD, AND I DON'T KNOW IF I WROTE THAT DOWN, UM, LET'S SEE, COMMEND STAFF ON A VERY RESEARCH, UM, PROJECT.

AND ONE OF THE THINGS THAT STOOD OUT WAS IT'S TOUGH ON DEVELOPMENT.

AND I THINK THAT'S, WE DIDN'T WANNA MAKE IT TOUGH, WE, BUT WE CERTAINLY WANTED TO MAKE IT CLEAR TO DEVELOPERS, UM, ON WHAT, UH, IS REQUIRED TO BE ABLE TO CREATE, UM, POTENTIAL PROJECTS WITHIN OUR LOCAL COMMUNITIES.

SO I I REALLY JUST, YOU KNOW, IN A NUTSHELL, THANK YOU.

IT, IT IS NOT AN EASY, UM, TASK TO OVERTAKE.

I MEAN, YOU WERE TALKING ABOUT 200 PAGES AND SOLIDIFYING THAT TO A HUNDRED PAGES OR 180 PAGES TO A HUNDRED PAGES OR SO FORTH.

AND NOT TAKING OUT, UM, THE VERBIAGE, BUT REALLY JUST CONDENSING IT TO HELP US ALL UNDERSTAND WHAT THAT MEANS.

SO THERE'S A LOT TO THAT.

SO I JUST WANT TO, UH, EXPRESS MY GRATITUDE TO YOU AND TO YOU AND ALL OF THOSE WHO WORKED ON THIS, AND EVERY INDIVIDUAL WHO CAME OUT TO OUR PUBLIC MEETINGS TO BE ABLE TO EXPRESS THEIR CONCERNS.

I WANT TO, YOU KNOW, ECHO, I'M NOT GONNA REPEAT WHAT SUPERVISOR WHITE SINGER SAID OF THEIR SENTIMENTS TO THE PEOPLE THAT HAVE CAME OUT AND LISTENED.

AND, AND I ECHO THOSE.

UH, WE APPRECIATIVE, I'M ALSO APPRECIATIVE OF THE DEVELOPERS WHO WERE PATIENT WHO COULD HAVE SUBMITTED PERMITS AND SAID, I WANT TO JUST PUSH THIS DOWN AND THROUGH, UH, BECAUSE YOU HAVE THIS ORDINANCE, BUT THEY WERE PATIENT AND LET US WORK THROUGH GETTING TO THIS POINT TODAY.

AND I THINK THAT TAKES A LOT OF, UH,

INTEGRITY ON THEIR PART, UH, TO BE GOOD NEIGHBORS AS THEY COME INTO THE COMMUNITY.

YOU KNOW, GROWING UP IN THIS AREA MY WHOLE LIFE AND BEING AWAY FOR A WHILE AND COMING BACK AND I THOUGHT WINDMILLS WERE FOUR, YOU KNOW, THE BIG PART THAT I FIRST SAW 'EM, I BELIEVE, WAS OVER IN, UH, CALIFORNIA AS YOU GO INTO TO THAT AREA.

AND I GO, WOW, YOU KNOW, IT'S OKAY.

IT'S DIFFERENT, YOU KNOW, AND THERE'S SOME GREAT MOVIES MADE OF PEOPLE FLYING IN WITH THEIR, UH, PARACHUTE, GETTING CAUGHT IN THE WINDMILLS AND ALL THIS STUFF THERE.

SO, YOU KNOW, YOU LOOK AT IT AND YOU GO, WHY WOULD WE EVER WANT THIS IN, IN, YOU KNOW, THIS AREA, THIS VAST? BUT YEARS AGO I STARTED TO UNDERSTAND AND LEARN THAT OUR SOLAR AND OUR WIND ENERGY IS VERY VIABLE IN THIS AREA, MORE SO THAN MANY OTHER PARTS OF THE NATION.

AND SO IT MAKES SENSE THAT WE'RE, WE'RE BLESSED IN AN AREA TO HAVE THOSE TYPE OF NATURAL RESOURCES.

AND SO I'M REALLY GRATEFUL TO SEE THAT WE ARE, UH, TAKING INITIATIVE STEP FOR THE FUTURE AS WELL.

AND I APPRECIATE THE COMMENTS THAT HAD BEEN SHARED TODAY ABOUT, UH, LOOKING FORWARD.

UM, IT'S BEEN EVIDENT TO ME THAT THE GOAL HERE IS BALANCE TO PROTECT THE HEALTH AND SAFETY OF THE COMMUNITIES AND RESPECT THE RIGHTS OF LANDOWNERS AND PRIVATE BUSINESSES.

UM, AND THAT'S PART OF WHAT'S BEEN AT STAKE HERE.

AND I KNOW THAT THERE'S PEOPLE THAT HAVE FEELINGS.

I'LL TELL YOU IF YOU REALLY CANDID, I HAVE PERSONAL FEELINGS AROUND WHETHER I WANT TO SEE THESE PROJECTS AS FAR AS VISUALLY FROM MY HOME OR WHETHER I WANT TO, BUT THAT'S NOT MY ROLE, NOR MY JOB HERE IS THE WAY I SEE IT ON THE BOARD OF SUPERVISORS.

AS A CONSERVATIVE, I BELIEVE DEEPLY IN PROTECTING PERSONAL, PRIVATE, UM, PROPERTY RIGHTS, UM, AND LIMITING GOVERNMENT OVERREACH.

AND JUST SIMPLY BECAUSE I MAY LIKE OR NOT, LIKE SOMETHING WOULDN'T BE THE APPROPRIATE THING TO DO, UM, JUST BECAUSE OF MAYBE SOME PRESSURES THAT WE'RE RECEIVING, UM, WHETHER I PERSONALLY LIKE THE PROJECT OR NOT, IF IT MEETS THE STANDARDS WE'VE SET, WE CAN'T LET A MOTION OVERRIDE PRINCIPLE.

UM, THE COUNTY ATTORNEY'S OFFICE GRANT, ANYTHING? YEAH.

UM, JUST, UH, MY, MY BOSS IS NOT HERE TODAY.

HE SENDS HIS APOLOGIES, BUT HE HAD A PREVIOUS COMMITMENTS DOWN THE VALLEY AND I THINK EVERY THREE OR FOUR YEARS, MELISSA REQUIRES THAT I HAVE PROOF OF LIFE, THAT I'M ACTUALLY ALIVE, THAT I'M HERE, AND THAT I, UH, ACTUALLY AM NOT JUST THE VOICE ON THE SCREEN.

SO, UM, THANK YOU FOR LETTING ME COME TODAY AND, UH, AND SIT IN, UH, PERHAPS SHOES ARE VERY GOOD TO, I APPRECIATE YOUR PATIENCE, SIR.

YOU KNOW, I THINK, UH, THIS, THIS WEEK'S KIND OF BEEN INTERESTING AND IT JUST KIND OF SPEAKS OF THE GREAT JOB THAT NAVAJO COUNTY AND OUR STAFF IS DOING.

I GOT SEVERAL LETTERS THIS WEEK, COMMENDING OUR PUBLIC WORKS, OUR PLANNING AND ZONING FROM PEOPLE THAT WE WOULDN'T EXPECT TO HEAR FROM.

I HAD A, A GUY THAT WAS QUITE UPSET ABOUT US TAKING THE ROCKS OUT OF HIS PROPERTY AND, AND THINGS, AND IT WAS INTERESTING, BUT HE, HE CALLED ME AND SAID, YOU KNOW, I KNOW THEY'RE STILL GONNA TAKE MY ROCKS OUT, BUT THANK YOU, THANK YOU TO THE COUNTY MANAGER WHO CAME OUT AND LOOKED AT THE SITE AND A LEASE SHOWED THAT HE WAS CONCERNED.

AND SO THOSE ARE THINGS THAT WE TRY TO DO AND TRY TO IMPROVE.

AND TODAY, AS WE SPOKE TO A LOT OF THE EMPLOYEES, THEY ENJOY WORKING FOR NAVAJO COUNTY.

AND AS WE PORTRAY THAT BACK TO THE CITIZENS IN KINDNESS AND IN THINGS THAT WE DO, I THINK WE BECOME BETTER.

AND WE LIVE IN A GREAT NATION.

WE LIVE IN THE RED, WHITE, AND BLUE.

AND I JUST WANT TO GIVE THANKS TO OUR COUNTRY AND KNOW THAT IT'S PROTECTED THAT WE'RE ONE NATION UNDER GOD AND GRATITUDE FOR THE 4TH OF JULY COMING UP.

I'M THANKFUL FOR OUR BRAVE SOLDIERS, BRAVE PEOPLE, PEOPLE WHO HAVE TO MAKE HARD DECISIONS SOMETIMES, AND WE JUST HAVE TO THEN LIVE WITH THE CONSEQUENCES OF THOSE DECISIONS.

UM, MY TEACHER SUPERVISOR, UM, I ATTENDED MY REGULAR CHECK MEETING AS WELL AS, UH, WATER SUMMIT AND FLEX STAFF, UM, THIS PAST WEEK.

UM, WE DO HAVE HIM FIRE ON NAVAJO MOUNTAIN IS AT ALMOST 2300 ACRES.

AND I WENT OUT THERE, UM, THE FIRST DAY THE FIRE STARTED, AND, UM, I WAS OUT TO ATTEND THE WESTERN AGENCY COUNCIL, BUT I DIDN'T DO SO BECAUSE, UM, COCONINO SUPERVISOR, UM, DURING THE BEGINNING I WANTED TO KNOW WHAT WAS GOING ON AND, UM, WE DIDN'T FIND OUT ABOUT THE, THE, THE, I DIDN'T GET ANY NOTICE FROM THE, FROM THE COUNTY UNTIL AFTER WE HAD BEEN OUT THERE.

SO, UM, IT IS REALLY STEEP AND I HOPE I SAID IT WAS FROM THE LIGHTNING, BUT IT SPREAD ALL OVER ON THE OTHER NORTH SIDE OF THE MOUNTAIN.

SO THAT'S, UM, ON THE UTAH SIDE, BUT WE'VE BEEN OUT THERE A FEW TIMES TO, UM, FOR SUPPORT AND TO, FOR PROVIDE, UM, WHAT IS NEEDED.

AND I ALSO WENT TO CANTAS, UM, ROAD COORDINATION MEETING WHERE THEY MET WITH INDO AND BIA TO DISCUSS, UM, A COUPLE OF BRIDGES AND A COUPLE OF ROADS.

SO THEY'LL BE REQUESTING SOME, UM, MATERIAL PURCHASES, UM, ON THOSE PROJECTS IN AREA AND TRO BETO AREA.

SO LOOKING FORWARD TO, UM, THE REQUESTS AND TRO BETO ALREADY HAS, UM, ONE IN.

SO, AND THEN OVER IN FOREST LAKE 80 65, UM, THE GRAVEL PROJECT'S BEEN COMPLETED.

AND ONE OF THE THINGS THAT WE HAVE BEEN TALKING ABOUT IS MEDICAID AND ITS IMPACT TO OUR LOCAL COMMUNITIES.

UM, WE RECENTLY REACHED OUT TO REPRESENTATIVE, OUR REPRESENTATIVES AND, UM, SENATORS TO BE ABLE TO INFORM THEM ABOUT HOW THAT COULD POTENTIALLY IMPACT NAVAJO COUNTY.

SO I JUST WANNA SHARE QUICKLY, UM, THIS COULD POTENTIALLY IMPACT, UM, SUMMIT AT, IN NAVAJO COUNTY, MAY FACE STAFF AND SERVICE REDUCTIONS INCLUDING MAJOR CUT TO LABOR AND DELIVERY LOSES LOSSES IN MILLIONS IN UNCOMPENSATED CARE AND A RISE IN AN UNINSURED PATIENTS.

UM, AND THERE ARE CERTAINLY MORE, BUT WHEN WE THINK ABOUT NAVAJO COUNTY, UM, PUBLIC HEALTH REDUCE IN ACCESS TO CARE, LOSS OF COVERAGE LIMITS ESSENTIAL HEALTHCARE FOR COUNTY RESIDENTS, DECLINING HEALTH OUTCOMES INCREASE MORTALITY, POORER CHRONIC AND BEHAVIORAL HEALTH OUTCOMES AND SHORTER LIFE EXPECTANCY WITHIN THE COUNTY.

EMERGENCY SERVICE OVERLOAD, OVERLOAD.

OVERLOAD, EXCUSE ME.

UM, MORE UNINSURED PATIENTS MAY STRAIN, UM, COUNTY OR ERS ECONOMIC DISRUPTION, JOB IN INCOME LOSSES IN VULNERABLE NAVAJO COUNTY COMMUNITIES AND CUT TO PUBLIC HEALTH SUPPORT REDUCES RESOURCE FOR COUNTY AGENCIES, AIDING AFFECTED POPULATIONS.

UM, AND CERTAINLY ONE OF THE THINGS THAT WHEN WE LOOKED AT, UM, OUR COMMUNITY, UM, SURVEY AND HEALTH RISKS, BEHAVIORAL HEALTH WAS VERY HIGH.

UM, THIS COULD POTENTIALLY IMPACT 90% OF THE SERVICES, UM, WHO NEED BEHAVIORAL HEALTH SERVICES, UM, THAT RELY ON ACCESS FUNDING.

UM, I THINK IT'S IMPORTANT FOR US TO REACH OUT TO OUR REPRESENTATIVES AND SENATORS TO INFORM THEM, UM, WHAT THIS NUMBER LOOKS LIKE FOR NAVAJO COUNTY IS THAT WE HAVE 60,000, UM, NAVAJO COUNTY CITIZENS WHO COULD POTENTIALLY BE IMPACTED BY THIS.

AND THIS IS CERTAINLY IMPORTANT WHEN WE LOOK AT HEALTHCARE SERVICES THROUGHOUT THE COUNTY.

UM, I JUST WANTED TO SHARE THAT REALLY QUICKLY.
