The Board may vote to meet in a closed executive session to discuss certain matters and for legal advice on any item as indicated on the following agenda, pursuant to A.R.S. § 38-431.03(A)(3). Items on the agenda may be considered out of order at the Chairperson's discretion. AND, UM, MY NAME IS, UM, FERN, BE, I AM THE VICE CHAIR FOR THIS YEAR, AND, UM, WE GOT INVOCATION AND PLEDGE, PLEDGE OF ALLEGIANCE BY SUPERVISOR WEISINGER, OUR KIND AND GRACIOUS HEAVENLY FATHER.

WE ARE SO GRATEFUL TO BE ABLE TO COME TOGETHER AS NEIGHBORS AND FRIENDS TODAY.

WE ASK FOR THY SPIRIT TO PEACE, TO BE WITH US, THAT WE WORK DILIGENTLY, TO BE PEACEMAKERS AND TO HEAR ONE ANOTHER, AND TO BE ABLE TO MAKE DECISIONS THAT ARE SOUND ON BEHALF OF OUR COMMUNITY MEMBERS.

HEAVENLY FATHER, WE ASK FOR THY BLESSINGS ON ALL THOSE WHO MIGHT BE IN NEED TODAY, THAT THE HAND OF GRACE BE UPON THEM, THAT THOSE WHO ARE SUFFERING AND SEEKING HELP, THAT WE MIGHT REACH OUT TO THEM AND KNOW OF THEIR DESIRE TO BE ABLE TO BE HELPED AND LIFTED UP HEAVILY.

FATHER, WE ASK THAT WE LOOK OUT FOR ONE ANOTHER, THAT WE LOOK OUT FOR OUR FRIENDS, THAT WE LOOK OUT FOR OUR NEIGHBORS, THAT WE LOOK OUT FOR OUR COMMUNITY MEMBERS, AND THAT WE SEEK OPPORTUNITIES TO SERVE HEAVEN.

FATHER, WE ASK FOR THY BLESSINGS OVER ALL THOSE WHO ARE SO WHO SERVE OUR COMMUNITIES, THOSE WHO GIVE UP TIME TO BE FIRST RESPONDERS, POLICE OFFICERS, FIREFIGHTERS, AND THOSE WHO SERVE IN MANY DIFFERENT CAPACITIES THROUGHOUT OUR COMMUNITIES THAT ARE NEEDED HEAVILY.

FATHER, WE'RE GRATEFUL FOR THEIR DESIRE TO SERVE AND GRATEFUL FOR THEIR DESIRE FOR THE WELLBEING OF OUR COMMUNITIES, AND WE ASK FOR THEY AND TO BE OVER THEM, THAT THEY MIGHT HAVE THE STRENGTH AND THE KNOWLEDGE TO BE ABLE TO UNDERSTAND THE BEST WAY TO HELP ONE ANOTHER.

WE ASK FOR THEY BLESSINGS IN ALL THINGS.

WE ARE GRATEFUL FOR THE MOISTURE THAT IT THAT HAS BEEN BROUGHT TO US AND ALL THAT IT SYMBOLIZES TO BE ABLE TO HAVE THE WATER THAT WE DRINK, AND FOR IT TO BE ABLE TO PROVIDE NOURISHMENT TO THE LAND AND TO BE ABLE TO PROVIDE THE FOOD THAT WE NEED TO BE ABLE TO SEE SUSTAIN OURSELVES AND OUR FAMILIES.

[c. PUBLIC HEARING: Consideration and adoption of the amended ordinance, Ordinance Number 03-11, amending Section 2 to increase the Justice Court Staffing Fee from $30 to $48 effective July 1, 2024. ]

AND WE GO TO ITEM TWO C, PUBLIC HEARINGS, CONSIDERATION AND ADOPTION OF THE AMENDED ORDINANCES.

ORDINANCE NUMBER ZERO THREE DASH ONE ONE AMENDING SECTION TWO TO INCREASE THE JUSTICE COURT STAFFING FEE.

FEE FROM $30 TO $48 EFFECTIVE JULY 1ST, 2024.

PRESENT, PRESENTED BY JASON MO.

GOOD MORNING, UH, VICE CHAIR AND, AND SUPERVISORS.

UM, THROUGH OUR BUDGETING PROCESS, WE GO THROUGH AND WE ANALYZE A LOT OF THE COUNTY'S FUNDS AND OUR ACCOUNTING SYSTEM.

AND, AND THROUGH THAT PROCESS, UM, IT CAME TO OUR ATTENTION THAT THIS ORDINANCE, UM, FOR THE JUSTICE COURT STAFFING FEE HAS NOT BEEN UPDATED, UM, SINCE 2012.

AND BECAUSE OF THAT, UM, WE RECOGNIZE THAT THE, THE FEE, UM, AS REQUIRED BY THE ORDINANCE, IT ACTUALLY MENTIONS IN THE ORDINANCE THAT WE SHOULD BE REVIEWING THAT YEAR OVER YEAR.

AND THAT WE HAD NOT DONE THAT.

SO, UM, AS PART OF OUR BUDGETING PROCESS, UM, WE, WE LOOKED AT THE, THIS, UM, ACTIVITY AND THE, THE, THE, THE REVENUE THAT'S RECEIVED IN THIS FUND TO HELP OFFSET SOME OF THE COSTS THAT THE COUNTY INCURS FOR DOING THAT.

SO, UM, JUST, JUST AS A LITTLE PRECURSOR, UM, THIS FEE, UM, IS TO HELP SUPPORT, UM, EIGHT, UM, CLERICAL AND ATTORNEY POSITIONS THROUGHOUT THE COUNTY.

SO SPECIFICALLY IN THE COUNTY ATTORNEY'S OFFICE IN OUR, IN OUR JUSTICE COURTS.

AND, UM, THE FEE IS BEING INCREASED FROM 30 TO $48, WHICH WE REALIZE IS A SIGNIFICANT INCREASE.

UM, HOWEVER, YOU KNOW, LIKE I SAID, WE HAVEN'T INCREASED THAT FEE SINCE 2012, AND IT'S SOMETHING THAT WE SHOULD HAVE BEEN DOING YEAR OVER YEAR INCREMENTALLY.

AND SO WHEN WE LOOKED AT THE METHODOLOGY OF HOW TO INCREASE THAT, WE, UM, HAVE ALSO KIND OF DONE SOME THINGS HERE RECENTLY WHEN WE'VE KIND OF LOOKED AT, UM, INCREASING SOME COSTS TO THE COUNTY AND, AND WE LOOKED AT THE INFLATIONARY MEASURES.

AND SO WE KIND OF USED THAT SAME PROCESS AND, AND, AND DID THIS CALCULATION LIKE THE SAME.

AND THAT'S HOW WE, WE LANDED AT THE, THE $48.

SO ESSENTIALLY WHAT THIS MEANS IS THAT, UM, IT'S ESTIMATED IN THE CURRENT FISCAL YEAR THAT WE'RE GONNA COLLECT ABOUT $223,000.

BY INCREASING THE FEE, IT WOULD RAISE IT TO $356,000.

UM, IN THE ORDINANCE ITSELF AND THROUGH THE BUDGET PROCESS, THE, THE TOTAL COST WITH THIS ACTIVITY IS $604,000.

SO THAT'S STILL NOT COVERING THE ENTIRE COST OF THE, THE ACTIVITY.

AND WE RECOGNIZE THAT, THAT THAT'S NOT REALLY WHAT THIS FEE IS MEANT TO DO, IS TO UNCOVER THE ENTIRE COST OF THE ACTIVITY.

AND SO WE DO TRANSFER, UM, FROM THE GENERAL FUND TO SUPPORT THIS AND THAT TRANSFER FROM THE GENERAL FUND, EVEN WITH THIS FEE INCREASE IS ABOUT 40%.

AND SO I DID GO BACK AND LOOK AT THE NUMBERS IN 2012.

UM, THE GENERAL FUND AT THAT POINT, UM, SUPPLEMENTED ABOUT EIGHT TO 10%.

AND SO, UM, YOU KNOW, THE, THE GENERAL FUND'S TAKING ON MORE OF THE BURDEN YEAR OVER YEAR, STILL WITH THE INCREASE IN FEE.

AND SO THAT'S WHY, UM, STAFF IS RECOMMENDING ADOPTION OF THIS ORDINANCE TO INCREASE THE FEE AND THEN, UM, GOING FORWARD TO, TO TAKE A, A MORE ACTIVE APPROACH IN LOOKING AT IT YEAR OVER YEAR TO

MAKE THAT INCREASE MORE INCREMENTAL.

SO WE'RE NOT IN THIS SITUATION AGAIN, TO HAVE TO MAKE SUCH A SUBSTANTIAL INCREASE FOR, FOR THE, FOR THE FEE.

AND SO AT THIS TIME, IF THE, IF THERE'S ANY QUESTIONS OR COMMENTS, I'D BE HAPPY TO ANSWER THEM.

UH, I THINK I'LL GO AHEAD AND HAVE, UM, OUR CLERK READ THE, READ, THE ONE THAT WE SENT, UM, MARINA, THE ONE THAT WE RECEIVED.

THE FIRST ONE THAT WE RECEIVED IS FROM JERRY BROWNLOW, PINETOP LAKESIDE, ARIZONA, YESTERDAY AT 12:22 PM DEAR MR. CHAIRMAN AND BOARD MEMBERS, I READ THROUGH THE PRESENTATION TO INCREASE THE FEES FROM 30 TO 48 PER CASE.

THAT IS A BIG INCREASE.

60% IS HUGE.

A SMALLER INCREASE DEPENDING ON WHAT THAT IS, COULD HELP IN SOLVING THE REQUEST.

I WOULD ASK THE BOARD TO FIND FUNDS NEEDED IN FOR THE REQUEST IN THIS YEAR'S BUDGET.

THE SECOND ONE WAS RECEIVED THIS MORNING REGARDING THE RECENT PROPOSAL TO INCREASE JUSTICE COURT SURCHARGES FROM RYAN REINHOLD PINETOP, ARIZONA.

I AM CONCERNED THAT NUMBER ONE, THE JUDICIAL BRANCH, JP COURT, THE JUDICIAL BRANCH, JP COURTS, IS INCREASINGLY FUNDING THE PROSECUTOR'S OFFICE, WHICH BYPASSES THE USUAL BUDGETARY PROCESS.

AND SO WE ARE SUPPLEMENTING, YOU KNOW, THAT TRANSFER FROM THE GENERAL FUND IS SUPPLEMENTING THAT.

AND SO YOU COULD LOOK, THAT'S ONE WAY TO LOOK AT IT, IS THAT THE, THE FEES THAT ARE COLLECTED, YOU KNOW, TO WOULD NOT REALLY IMPACT THE, THE PROSECUTOR'S SIDE OF WHAT'S BEING CHARGED INTO THIS FUND.

AND THE FEE, HOW MANY PEOPLE DO WE ESTIMATE THAT THAT'LL IMPACT? I I DO NOT HAVE THAT, THAT INFORMATION.

AND SO, YOU KNOW, IN, IN LOOKING AT THE, THE ACTIVITY, I MEAN, SO THE, THE ISSUE IS WE HAVE A SET COST, RIGHT? 'CAUSE WE, WE HAVE EIGHT EMPLOYEES THAT THIS HELPS TO, TO PAY FOR.

AND LIKE I SAID, IT DOESN'T PAY FOR ALL EIGHT EMPLOYEES A HUNDRED PERCENT.

IT'S ABOUT EVEN RAISING THE, THIS FEE, IT'S GONNA COVER ROUGHLY ABOUT 55 TO 60% OF, OF THOSE COSTS.

UM, WHAT IT LOOKS LIKE FROM THE REVENUE SIDE OF THINGS IS, YOU KNOW, THAT'S GONNA VARY ON THE ACTIVITY.

SO, YOU KNOW, AS YOU KNOW, THESE KIND OF CASES INCREASE OR DECREASE YEAR TO YEAR, THAT REVENUE IS GOING TO INCREASE OR DECREASE WITH THAT.

BUT I DO NOT HAVE THE EXACT NUMBER OF, OF YOU KNOW, WHAT THAT IS FROM YEAR TO YEAR.

BUT I CAN GET THAT FOR YOU.

AND HOW, UM, WAS THE NUMBER ASSESSED TO GO TO A 60% INCREASE AND WHEN WE DIDN'T MEET THE FULL, UM, THE POTENTIAL AMOUNT, I GUESS THAT COULD HAVE BEEN INCREASED.

YEAH.

HOW WAS THAT? SO, UM, THERE'S BEEN, THERE'S BEEN A COUPLE OTHER, UM, THINGS THAT HAVE COME UP.

SO FOR EXAMPLE, UM, UM, MORTUARY SERVICES THAT, THAT WE PAY FOR.

UM, SO THE MORTUARIES CAME TO US AND SAID THAT, YOU KNOW, THESE CONTRACTS ARE OUTTA DATE AND WE NEED TO INCREASE THE FEE.

AND SO WE WENT THROUGH A PROCESS OF LOOKING AT WHAT WE PAY OUT AND, AND IN THOSE INFLATIONARY RATES FROM YEAR TO YEAR.

AND THEN WE TOOK THAT SAME METHODOLOGY THAT, THAT WE WOULD PAY, THAT WE AGREED TO WITH THEM AND A COUPLE OF OTHER THINGS THAT, THAT WE WERE, THAT NEEDED TO BE UPDATED AND LOOKED AT THAT.

AND SO BASICALLY WE FIGURED OUT AN INFLATIONARY RATE FOR THE FIRST, YOU KNOW, FROM YEAR TO YEAR AND THEN KIND OF APPLIED THAT TO, TO THIS RATE HERE.

AND THAT'S HOW WE LANDED AT THE $48.

AND WE FELT THAT THAT WAS FAIR BECAUSE IT WAS CONSISTENT WITH HOW WE WERE BEING THAT WE'VE BEEN TREATING OTHER CONTRACTS.

IS THERE A COMPROMISE THERE? THERE'S ALWAYS A COMPROMISE.

AND SO IF WE, IF WE WERE TO SAY HALF OF THE COST, UM, SO IT'D BE $8 INCREASE.

UM, DOES, DO WE HAVE THE BUDGETARY ABILITY TO DO THAT? I THINK I WON'T GO ON.

I'LL JUST ASK THAT QUESTION.

I MEAN WE, WE HAVE SOME, SOME FUNDING MECHANISMS THAT WE COULD, WE COULD, WE COULD, UM, BASICALLY IT WOULD BE REQUIRE MORE OF A TRANSFER FROM THE GENERAL FUND TO OFFSET THE, THE COST OF, OF WHAT'S GOING ON.

UM, LIKE I SAID, STAFFS RECOMMENDING THIS 'CAUSE IN 2012 THAT THAT COST TO THE GENERAL FUND WAS 8%.

AND EVEN WITH THIS INCREASE GOING FORWARD TO THE CURRENT FISCAL YEAR, THAT COST TO THE GENERAL FUND IS GONNA BE 40% OF THE COST OF THE ACTIVITY.

SO THE CURRENT COST IS $220,000.

THAT'S, THAT'S THE REVENUE THAT, THAT WE'RE PROJECTING TO FINISH UP AT THE END OF THE YEAR HERE IN THE NEXT WEEK OR SO.

AND THEN WITH THE INCREASE THAT'S ANTICIPATED AT 350 YES.

WHICH IS A, A 60% INCREASE.

SO I AM OKAY WITH THE INCREASE.

IT IS A LARGE INCREASE, BUT IT ALSO GOES TO WHERE THOSE PEOPLE, THEY DON'T HAVE TO PAY THAT FINE IF THEY'RE NOT BREAKING THE LAW.

AND SO IT'S JUST KIND OF A COST OF ASSOCIATED OR TRANSACTIONS THAT THEY'RE DOING.

AND SO WE SHOULD HAVE BEEN ON TOP OF THIS A LITTLE BIT SOONER, BUT AT THE SAME TIME, UH, WE'RE TRYING TO BRING YOU UP TO DATE.

IT DEPENDS ON WHAT THE NATURE OF THE TRAFFIC OFFENSE IS.

IF IT IS A CRIMINAL TRAFFIC OFFENSE, BE IT A-D-U-I-A RECKLESS DRIVING CRIMINAL SPEED, THAT IS SOMETHING THAT THE PROSECUTOR'S OFFICE PROSECUTES ON BEHALF OF THE STATE.

UH, THERE HAS BEEN A SIGNIFICANT DECREASE IN CIVIL SPEED TRAFFIC CASES OVER THE LAST TWO YEARS BECAUSE OF A LEGISLATIVE CHANGE THAT ALLOWS PEOPLE TO MORE FREQUENTLY USE THE TRAFFIC SCHOOL TO GET OUT OF OFFENSES.

SO IN THOSE CASES, THERE IS NO, UH, COSTS ASSOCIATED WITH IT 'CAUSE THEY'RE DOING IT AS ESSENTIALLY IT'S A DIVERSION OUTSIDE OF THE, OF THE COURT ITSELF.

UM, I'M NOT SURE WHY MR. REINHOLD ONLY SAID IT'S FUNDING.

THE PROSECUTOR'S OFFICE IS ALSO, I BELIEVE, ACCORDING TO THE, UH, ITEM ITSELF, ALSO HELPING TO DEFRAY THE COST OF THE PUBLIC DEFENDER'S OFFICE.

AND I'M NOT SURE HOW THE IMPACT OF A FEE AND IN ANY WAY IMPACTS THE POTENTIAL IMPARTIALITY OF THE JP COURT.

UH, I DON'T, THEY JUST, THEY ROUTINELY IMPOSE MANDATORY STATE FINES, FEES, SURCHARGES AS IT IS.

THAT IS TITLE 11, CHAPTER SEVEN, ARTICLE SIX AND 6.1.

SO FOR THE AGGRESSIVE ONE, WE CHANGE VICIOUS, TOO AGGRESSIVE PURSUANT TO A RS STATUTE, 11 14 0 1, UH, FOR ATTACK.

MANY PEOPLE, WE HAD THIS ISSUE, AND THIS IS KIND OF HELPING US

MANY OF THE ANIMAL COMPLAINTS THAT WE ARE INVESTIGATING, THE ANIMALS ARE IN DEPLORABLE CONDITIONS, WHICH CAN CAUSE DISEASE AND, AND INJURIES.

AND BRANDON WILL TELL YOU ANOTHER ISSUE THAT WE'VE HAD.

ALL RIGHT, SO FOR THIS ONE, UM, WE'RE MORE LOOKING AT THE SANITARY ENVIRONMENT.

SO WE HAVE A GENTLEMAN THAT HAS OVER 40 DOGS.

THEY'RE LIVING IN TRASH AND FECES.

WELL, IN OUR ORDINANCE RIGHT NOW, WE'RE NOT ALLOWED TO DO ANYTHING BASED OFF OF THAT 'CAUSE HE DOES HAVE THE PROPER SHELTER, WATER AND FOOD.

WE WOULD LIKE FOR HIM TO CLEAN IT UP.

WE CAN GIVE, WE HAVE A FORM THAT'S ORDER TO COMPLY, BUT THAT DOES NOT MEAN THAT HE HAS TO CLEAN IT UP, UM, BECAUSE WE HAVE NOTHING TO ISSUE THE CITATION OFF OF.

WE DO HAVE AC CRUELTY LAW THAT IS BY A STATUTE.

UM, BUT THOSE ARE CLASSIFIED FELONIES.

THESE WOULD JUST BE THE CRIMINAL MISDEMEANORS UNDER THIS CRUELTY UNDER OUR ORDINANCE.

SO IT WOULD BE NICE TO PUT 'EM, GET THIS IN THERE.

AND I JUST WANTED TO ADD THAT THERE IS A, RIGHT NOW FOR CRUELTY, THERE IS A, IT'S A 30 BASICALLY, UH, AMENDING THE NEW CRUELTY LAW.

IT'S 13 DASH 29 12 IN THE CRIMINAL STATUTE.

IT'S IN THE HOUSE RIGHT NOW, AND IT CLEARLY, AND IT'S ACTUALLY CLEARLY DEFINING CRUELTY, AND THEY HAVE A LOT MORE INFORMATION IN THERE.

UM, THEY HAVE THE DUTY TO REPORT, IT DEFINES ABANDONMENT, AND IT ALSO GIVES LANDLORD RIGHTS, WHICH LETS THE LANDLORD ADDRESS ISSUES WITH TENANTS ON THEIR PROPERTY.

SO THAT WAS BROUGHT TO THE HOUSE IN FEBRUARY.

SO HOPEFULLY BY THE END OF THIS CLOSURE OF THIS FISCAL YEAR IN OCTOBER-ISH, IT WILL BE PASSED.

SO NOW FOR OUR ORDINANCE, WE WANTED TO ADD FIVE NEW ORDINANCES.

OUR FIRST ONE IS KEEPING OF WILD OR EXOTIC ANIMALS.

IT, IT WOULD BE NICE TO KNOW IF THERE'S ANY EXOTIC ANIMALS IN OUR COUNTY, UM, THAT COULD POSSIBLY OR POTENTIALLY BE SPREADING OTHER DISEASES OR VIRUSES THAT WE DON'T NECESSARILY KNOW ABOUT.

KEEPING OF HORSES REFERRED TO THE COUNTY ORDINANCE SECTION 3 0 2 15, WHICH GIVES THEM MORE INFORMATION ON THE SETBACKS AND THE CORRAL SIZES.

UM, IT, IT WAS KIND OF REDUNDANT TO HAVE BOTH IN BOTH, UH, AREAS.

UH, WE WANTED TO DEFINE THE QUARANTINE OF AREAS AND THE ANIMALS.

NOW THIS ONE, IT COMES FROM THE A RS STATUTE 11 DASH 1 0 0 1.

IT CLEARLY DEFINES THAT IF YOU, THE BOARD OF SUPERVISORS HAVE THE AUTHORITY TO, TO, UH, TO MAKE AN AREA A QUARANTINE AREA.

UM, SO JUST A, A TIDBIT OF INFORMATION.

UH, LAST YEAR WE ONLY HAD TWO RABIES,

AND THIS IS TO ASSIST US IN OUR CIVIL CASES.

UM, AND THE HEARING OFFICER PROTOCOL, OUR PROCEDURES WERE, UM, APPROVED BACK IN JANUARY OF THIS YEAR.

WE ARE MISSING THEM IN OUR CURRENT ORDINANCE.

AND NUMBER FIVE, WE WANTED TO ADD MORE PENALTIES FROM THE ARIZONA STATE RE REVIVED STATUTES.

SO, FOR EXAMPLE, UNDER THE KENNEL PERMITS, IF A PERSON HAS BEEN CONVICTED OF THAT ANIMAL CRUELTY LAW, WHICH IS A CRIMINAL, UM, STATUTES TITLE 13, WE CAN DENY THEM A PERMIT.

AND, UH, WE CAN ALSO CHARGE THEM A $75 FEE TO GET THAT PERMIT OR THE ACTUAL COST OF RECOVERY.

UM, AGAIN, WE'RE GONNA FOLLOW THE A RS STATUTE 11 DASH 1 0 0 5 A SIX, WHICH GIVES A CLASSIFICATION AND, UH, FOR THE VIOLATIONS.

UM, SO CIVIL PENALTIES CAN EXCEED OVER $500 PER VIOLATION.

AND THE CRIMINAL CRIMINAL PENALTIES CANNOT EXCEED A CLASS TWO MISDEMEANOR.

SO THIS IS OUR FEE SCHEDULE.

IT ALSO ENCOURAGES ANIMAL OWNERS TO TAKE RESPONSIBILITY FOR THEIR PETS, FOSTERING A MORE HARMONIOUS COMMUNITY.

THE SECOND ONE I WANTED TO LOOK AT WAS THE, THE KENNEL PERMIT.

AGAIN, THAT WAS AN A STATUTE.

IT, IT CLEARLY DEFINES IT IN STATUTE.

IT PROVIDES AWARENESS OF POSSIBLE HOARDING SITUATION LIKE BRIAN BRANDON TALKED ABOUT THE 40 DOGS.

UM, THE SECOND ONE, IT'LL ALSO HELP US BE PROACTIVE IN ADDRESSING ISSUES OF ODOR OVERCROWDING IN OUR SHELTERS.

THIS WOULD BE IN EFFECT FROM NOVEMBER 1ST UNTIL APRIL 1ST, INCLUSIVE OF EVERY YEAR.

UM, THE INTENT OF THIS ORDINANCE IS TO PREVENT THE, THE PARKING OF VEHICLES AND TRAILERS AS WELL AS THOSE STORAGE CONTAINERS WITHIN COUNTY MAINTAINED RIGHT OF WAYS DURING OUR TYPICAL SNOW SEASON.

UH, THE REASON THIS ORDINANCE IS KIND OF COME FORWARD IN STAFF'S MIND, AND WE'RE PRESENTING THIS TO YOU IS THOSE TYPES OF VEHICLES BEING PARKED DURING SNOW EVENTS CAN, UH, DELAY OR OUTRIGHT PREVENT THE ABILITY OF OUR PUBLIC WORKS EMPLOYEES TO GO OUT AND MAINTAIN AND DO SNOW REMOVAL ON ROADWAYS.

UM, SO THIS WOULD OFFER A MECHANISM FOR LAW ENFORCEMENT TO, UH, TOW FOR ANY TYPE OF OFFENSE.

AND THEN WITH FIRST OFFENSES, THERE COULD BE A FINE OF A HUNDRED DOLLARS AND 200 FOR ANY SUBSEQUENT, UM, THAT WOULD BE DISCRETIONARY AS FAR AS IT GOES.

SO THERE'S NOT THE OBLIGATION THEY'RE ABLE TO SEE IF THAT DOES ACTUALLY INHIBIT THAT MAINTENANCE.

UM, SO IT'S NOT JUST A BLANKET YOU CAN ACTUALLY APPLY WHERE THAT MAINTENANCE WOULD BE INHIBITED IN THE DEVELOPMENT OF THIS.

I WORKED WITH PUBLIC WORK STAFF AS WELL AS REPRESENTATIVES FROM THE SHERIFF'S OFFICE SO THAT WE COULD REFINE THIS AND GET THIS TO A LEVEL OF LANGUAGE THAT EVERYONE WOULD BE COMFORTABLE WITH, BUT ALSO TO MAKE SURE THAT WE'RE ABLE TO DO, UH, SAFE AND TIMELY MAINTENANCE OF OUR ROADS DURING THAT WINTER SNOW SEASON.

THE CITY OF WINSLOW HAS ON THEIR AGENDA FOR TONIGHT'S CITY COUNCIL MEETING TO APPROVE A DEVELOPMENT AGREEMENT BETWEEN TWO COUNTIES AND A VILLAGE IN NEW MEXICO.

WINSLOW AND KINGS KINGMAN KINGMAN IN ARIZONA AND TRADE PORT DEVELOPMENT LLC AS WELL AS LOBBYIST SERVICES TO SECURE RAISE GRANTS FOR THE I 40 TRADE PORT CORRIDOR AND THE PURCHASE AND SALE AGREEMENT BETWEEN WINSLOW AND ATLAS GLOBAL.

AS PART OF THIS OVERALL TRADE PORT PLAN, THE CITY COUNCIL AND MAYOR OF WINSLOW WANT TO HAVE A BYPASS ROUTE DIVERTING TRUCK TRAFFIC FROM THE I 40 DOWN SOUTH AND LOOP EASTWARD TOWARD THE 87.

THIS IS THE STATED REASONING FOR THE APPLICATION OF THE RAISED GRANT.

I DON'T HAVE TIME TODAY TO DE TO ADDRESS ALL THE RED TAPE ASSOCIATED WITH THIS GRANT.

ATLAS GLOBAL HAS BEEN BUYING UP PROPERTY IN THIS AREA IN THE HOPES OF DEVELOPING A 3,750 ACRE INDUSTRIAL MEGA SITE.

ON PAGE SIX, THEY DESCRIBED THE EXISTING SITE CHARACTER AS PRIMARILY VACANT LAND WITH INTERSPERSED RESIDENTIAL PARCELS.

THE FUTURE OF THIS AREA, AS YOU CAN SEE FROM THE COVER, WHICH I'LL GIVE TO YOU, IS BUILT TO BUILD HOTELS, HANGERS, LIGHT, INDUSTRIAL, INDUSTRIAL COMMERCE PARK, AND MULTIFAMILY HOUSING.

THIS AREA WOULD NEED TO BE ANNEXED TO THE CITY AND ZONED COMMERCIAL TO FULFILL ATLAS GLOBAL'S PLAN FOR THE AREA.

THE ONLY PROBLEM IS THE PESKY INTERSPERSED RESIDENTIAL PARCEL STANDING IN THE WAY.

THE RESIDENTS OF THOSE PARCELS HAVE BEEN LOUDLY PROTESTING THE ANNEXATION TO THE CITY ATLAS GLOBAL'S PLAN FOR THE AREA AND TYPES OF COMMUNITIES OR COMPANIES THEY'RE TRYING TO ATTRACT AND WHAT THEY SEE AS ULTIMATELY LOSING THEIR RIGHTS AND PROPERTY THROUGH THE EMINENT DOMAIN TO FURTHER THE AGENDA OF THIS PROJECT.

AS A CO COUNTY PROPERTY OWNER, YOUR ONLY RECOURSE IS TO ADDRESS THE COUNTY.

THAT IS WHAT I'M HERE DOING TODAY.

WE ARE VERY CONCERNED ABOUT THE ELECTION MACHINES, THAT THERE IS SO MUCH DIFFICULTY THAT WAS, UH, OBSERVED IN THE LAST SELECTION WITH THEM PERSONALLY.

I OBSERVED WHEN I MADE MY BALLOT AND PUT MY BALLOT INTO THE MACHINE, I HAD TO DO IT THREE TO FOUR TIMES BEFORE IT, UH, ACTUALLY TOOK THE BALLOT.

MY UNDERSTANDING WAS THAT OTHER DISTRICTS HAD SIMILAR PROBLEMS WITH THESE MACHINES.

MY CONCERN IS THAT WE SHOULD GO TO A HAND BALLOT WITH OBSERVERS OR CAMERAS OBSERVING THE INTEGRITY OF THE ELECTION PERIOD.

UM, THE MACHINES HAVE HAD A HISTORY AND, UM, MY UNDERSTANDING OF LAWSUITS AGAINST THESE MACHINES AND ANY CORRECTIONS AS LONG AS THEY'RE INTERNET RELATED CAN BE HACKED AND THESE MACHINES ARE CAPABLE OF DOING THAT.

MY CONCERN IS THAT THE BOARD TAKE A SECOND LOOK AT THESE MACHINES AND CONSIDER NOT EVEN USING THEM AND GOING TO A HAND COUNT AND PROVIDING EITHER THROUGH THE SHERIFF'S DEPARTMENT OR THROUGH A SPECIAL TRAINING OF, UH, QUALIFIED OBSERVERS TO OBSERVE THE ACTUAL COUNT, HAND COUNT OF THE BALLOTS SO THAT WE DO HAVE ELECTION INTEGRITY AND THAT THEY CAN BE REVIEWED AT A LATER DATE.

SO INSTEAD OF PAYING $5,616,000 FOR THE EXTRA MANPOWER TO COVER THE 17 DROP BOXES THAT ARE CURRENTLY AROUND THE COUNTY, I, UH, SUGGEST THAT WE USE THAT MONEY TO HIRE PEOPLE TO BE ABLE TO DO A HAND COUNT IN THE, UH, COUNTY.

AND, UM, THE TRAINING HAS BEEN OFFERED TO YOU.

THE, UH, STATE OF MISSOURI HAS PUBLISHED A HAND COUNT MANUAL AND IT'S BEEN ACCEPTED BY THE STATE OF MISSOURI.

IT'S ALREADY BEEN ESTABLISHED THAT BALLOT DROP BOXES ARE NOT COVERED IN SECTION 16 OF THE ARIZONA REVISED STATUTES.

AND SO IT IS REASONABLE FOR A YAVAPAI COUNTY SUPERIOR COURT JUDGE TO RULE THAT THE LEGISLATURE HAS NOT REQUIRED THAT THESE DROP BOXES ALWAYS BE MONITORED.

HOWEVER, THE USE OF BALLOT DROP BOXES IS CLEARLY SPELLED OUT IN THE ELECTION PROCEDURES MANUAL IN SECTION I NUMBER ONE, LETTER C, THAT BALLOT DROP BOXES QUOTE MUST BE MONITORED BY A PROPERLY TRAINED EMPLOYEE OR DESIGNEE OF THE COUNTY RECORDER OR OFFICER IN CHARGE OF ELECTIONS AT ALL TIMES THAT THE LOCATION OR DROPBOX IS ACCESSIBLE BY THE PUBLIC.

THAT SEEMS VERY CLEAR TO ME.

AND YET WHEN COUNTY MANAGER LEIGHTON QUESTIONED THE SECRETARY OF STATE CONCERNING THIS, HIS REPLY WAS THAT THERE IS NO REQUIREMENT THAT DROP BOXES BE CONTINUOUSLY MONITORED EITHER IN PERSON OR BY CAMERA.

THE ELECTION PROCEDURES MANUAL OR EPM IS PRODUCED BY THE SECRETARY OF STATE'S OFFICE AND COVERS IN GREAT DETAIL MOST ELECTION PROCESSES AND PROCEDURES.

THE ANSWER THAT MANAGER LAYTON RECEIVED IS A DIRECT CONTRADICTION TO THE STATED REQUIREMENT IN THE EPM.

HOW CAN THE COUNTY RECONCILE THIS CONTRADICTION FROM THE SECRETARY OF STATE? SINCE THE ANSWER TO THIS QUESTION AFFECTS NAVAJO COUNTY ELECTIONS, IT WOULD SEEM OBVIOUS TO ASK THE RESPONSIBLE LAW ENFORCEMENT AGENCY FOR THE COUNTY, THE SHERIFF'S DEPARTMENT, AND THAT IS WHAT WE WILL DO.

AS A FINAL COMMENT, IF ELECTIONS WERE DONE WITH PAPER BALLOTS WITH IN-PERSON VOTING ON ELECTION DAY, HAND COUNTED AT EACH POLLING PLACE, THEN AT LEAST 80% OF THE ELECTION PROCEDURES MANUAL COULD BE COMPLETELY ELIMINATED LIKE OUR GRANDPARENTS TOLD US.

BUT WE STILL HAVE A HUGE PROBLEM WITH THE DS FOUR FIFTIES AND THE EIGHT FIFTIES.

THE COUNTY'S ALSO BEEN PUT ON NOTICE FOUR MONTHS ABOUT DOING A FULL SECURITY ASSESSMENT ON THE MACHINES, THE COUNTY.

UM, THE COUNTY COULD HAVE NOTIFIED US ABOUT THE LOGIC AND ACCURACY TEST THAT THEY HAD YESTERDAY.

UM, WE JUST FOUND OUT ABOUT IT ON A WHIM BY JUST CALLING UP THE ELECTIONS DEPARTMENT.

THEY GO, OH, BY THE WAY, WE'RE HAVING A LOGISTICS TEST.

SO, UM, THAT SHOULD HAVE BEEN ON THE WEBSITE.

AND MY QUESTION IS, IS WHERE'S YOUR TRANSPARENCY? YOU KNOW, WHY WASN'T THAT POSTED? UM, WE COULD HAVE EASILY DONE AN ASSESSMENT AND THEN WE COULD HAVE PROVEN TO YOU AND TO THE PUBLIC WHAT'S REALLY GOING ON WITH THESE MACHINES AND PROVIDES METHODS TO CORRECT IT.

WE'VE ALWAYS VOTED IN PERSON.

ADDITIONALLY, OUR DAUGHTER RECEIVED THREE MAIL-IN BALLOTS.

SHE HAD NEVER ASKED FOR MAIL-IN BALLOTS, BUT SHE RECEIVED THEM.

SHE ALSO VOTES IN PERSON.

THE A RS REVISED STATUTES STATES AS TO THE RESPONSIBILITY OF THE COUNTY BOARD OF SUPERVISORS TO ADMINISTER, PREPARE, CONDUCT, TALLY, FEDERAL, STATE, AND COUNTY ELECTIONS.

I'M COMPELLED TO HIGHLIGHT THE SIGNIFICANCE CONCERNS REGARDING OUR REGISTRATION AND ELECTIVE SYS ELECTION SYSTEMS. THERE HAVE BEEN REPORTED MANY IRREGULARITIES IN THE SYSTEMS AND IT'S APPARENT AND IT ALSO INDICATES DEFICIENCIES IN OUR ELECTION MANAGEMENT, THE PROCESSES AND THE RESPONSES FROM THE REGISTRAR OF VOTERS.
