THE PROJECT AND ITS SUBMITTAL MEET ALL THE REQUIREMENTS OF SECTION 25 21 OF THE ZONING ORDINANCE, WHICH REGULATES THE WIRELESS COMMUNICATION. FACILITIES PLANNING AND DEVELOPMENT SERVICES. STAFF HAVE RECEIVED, UH, ONE LETTER FROM A CONCERNED CITIZEN STATING SHE WAS OPPOSED. UH, STAFF WAS ABLE TO REACH OUT TO THIS CITIZEN AND ALLEVIATE SOME OF THOSE CONCERNS. SHE STATED THAT SHE WAS FELT MORE COMFORTABLE ABOUT THE PLACEMENT OF THE TOWER. SHE DIDN'T SAY WHETHER OR NOT SHE WAS STILL OPPOSED, THOUGH COMING TO OUR FINDINGS EFFECT, IT HAS BEEN PROPERLY NOTICED AND POSTED IN ACCORDANCE WITH STATE LAW IN ARTICLE 29. IT IS IN COMPLIANCE WITH OUR COMPREHENSIVE PLAN. THIS USE IS COMPATIBLE WITH THE PERMISSIBLE USES IN THE ZONING DISTRICT IN WHICH THIS PROPERTY IS LOCATED. SO THEY WERE AWARE OF WHAT RIGHTS AND RESPONSIBILITIES THERE WERE RELATED TO THESE CELL TOWERS AND WHAT PURVIEW THERE WAS THROUGH THE HEARING PROCESS. UM, IN THOSE 10 MONTHS WE'VE GONE THROUGH AND ANALYZED WHAT'S BEEN WORKING, WHAT HASN'T, AND REALLY JUST WHAT NEEDS A, A GENERAL CLEANUP AS YOU SEE OVER TIME WITH SOME OF THESE. UM, THIS IS NOTHING MAJOR, BUT I WILL JUST KIND OF WALK THROUGH, UM, EACH OF THE OVERVIEWS OF THE AMENDMENTS THAT WE'VE PROPOSED HERE FOR CHANGES. NOW, THE COMMISSION MAY, MAY NOT RECALL THAT PROVISION, UH, BECAUSE THAT WAS NOT WHAT CAME IN FRONT OF THE COMMISSION LAST YEAR WITH THE ORIGINAL, UH, PROPOSAL FOR THIS ORDINANCE THAT WAS ADDED BY THE BOARD OF SUPERVISORS. THEY WANTED TO ADD THAT OPTION AND POTENTIALLY, UH, WHAT WE FOUND OVER THE PAST YEAR IS WHEN AN ITEM ENTERS THE HEARING PROCESS FOR THESE RESIDENTIAL PROPERTIES, AND IT'S OUT OF COMPLIANCE, BUT COULD APPLY FOR A WAIVER, UM, THAT CAN CAUSE CONFUSION AND FRUSTRATION, NOT JUST FOR THE APPLICANTS, BUT ALSO FOR THE GENERAL PUBLIC, UM, WHO MAY FEEL THAT THEY'VE BEEN MISLED OR DO NOT UNDERSTAND THE INFORMATION AND FEEL THAT SOMETHING SHOULD BE OUTRIGHT DENIED, UM, BECAUSE IT HASN'T YET BEEN GRANTED A WAIVER BUT HAD TO BE HEARD ON THE FLOOR. WHAT WE'RE TRYING TO PREVENT IS HAVING THOSE ISSUES BEING HEARD ON THE BOARD OF SUPERVISORS FLOOR GOING FORWARD. UM, SO AS [00:15:01] WITH ALL DEVELOPMENT STANDARDS THAT WE HAVE WITHIN OUR ZONING ORDINANCE, THIS DOES NOT SAY THAT THERE CAN'T BE EXCEPTIONS TO THIS RULE. THIS WOULD JUST FALL BACK ON REQUIRING A VARIANCE BEFORE APPLYING FOR THE SPECIAL USE PERMIT PROCESS FOR THAT SETBACK. SO THAT WOULD BE A SEPARATE HEARING PROCESS WHERE IT'S VERY CLEAR AS TO WHETHER OR NOT THOSE REDUCED SETBACKS HAD BEEN APPROVED PRIOR TO A TOWER COMING THROUGH FOR A SPECIAL USE PERMIT. WITH THAT, WE HOPE TO PREVENT THE CONFUSION OF MAKING ANY CHANGES, UH, TO WHAT HAS GONE THROUGH DURING THE HEARING PROCESS. SO REALLY WE'RE PROPOSING THAT THIS LEAVE THE SPECIAL USE PERMIT PROCESS AND GO TO THE BOARD OF ADJUSTMENTS SO THAT IT'S TAKEN CARE OF PRIOR TO COMING INTO ANY OF THIS INTO YOUR CHAMBERS. UM, THE SECOND IS STRIKING THE APPLICATION REQUIREMENT FOR CERTIFICATION OF COMPLYING WITH FEDERAL STANDARDS. AND TYPICALLY WHAT WE SEE IS JUST A CERTIFICATION LETTER STATING THAT THE APPLICANTS WILL COMPLY WITH FEDERAL STANDARDS. THIS IS NOT BECAUSE WE DON'T WANT THEM TO COMPLY WITH THIS. THIS IS A REQUIREMENT. WHAT WE FOUND IS THIS IS A REDUNDANCY WITHIN OUR PROCESS. SO WE ALREADY REQUIRE PRIOR TO SUBMISSION, UM, THAT ALL FEDERAL LICENSING BE SUPPLIED TO US AS STAFF, WHICH REQUIRES COMPLIANCE WITH FEDERAL LAW. UM, SO THIS IS JUST AN ADDITIONAL STEP, UH, THAT IT DOESN'T ADD ANYTHING TO THE PROCESS. IT, IT JUST BECOMES REDUNDANT, A BIT OF A DIFFICULTY FOR THE APPLICANT. THAT'S UNNECESSARY POTENTIALLY. WE ALSO, UM, LIKE IF YOU CAUGHT IT ON TYLER'S SLIDE THERE, HAVE YOU SEEN ANY OF THE OTHER APPLICATIONS? WE DO REQUIRE COMPLIANCE WITH ALL FEDERAL REGULATIONS. ON TOP OF THAT LICENSING WITH OUR OWN AUTHORITY HERE IN THE JURISDICTION, WE'VE ALSO RECOMMENDED STRIKING THE APPLICATION REQUIREMENT FOR NOTIFYING APPROPRIATE AGENCIES. AND THAT AGAIN, COMES DUE TO A REDUNDANCY. ALL OF THESE APPLICATIONS THAT COME IN HAVE TO GO THROUGH THE CONCEPTUAL AND PRE-APPLICATION PROCESS WITH STAFF TO VET AND REVIEW BEFORE THEY'RE ACCEPTED AND GO TO THE COMMISSION TO TAKE CARE OF NECESSARY ISSUES. AND DURING THAT PROCESS, NAVAJO COUNTY STAFF NOTIFIES ALL OF THE RELEVANT JURISDICTIONS THAT ARE INVOLVED HERE. UM, AND WE BRING THEM IN FOR COMMENTS OR ALLOW THEM TO PROVIDE WRITTEN COMMENTS. SO ONCE AGAIN, THIS IS, IT IS A STEP THAT'S ALREADY OCCURRING AND WE'D JUST LIKE TO TAKE OUT THE REDUNDANCY THAT PUTS THAT ON THE APPLICANT SINCE IT'S ALREADY REQUIRED COMING THROUGH STAFF. THE FINAL RECOMMENDATION THAT WE HAVE HERE IS THAT WE WOULD ADD IN WIRELESS COMMUNICATION FACILITIES AS PERMITTED FOR ALL GOVERNMENT AGENCIES. AND THAT'S BECAUSE THE VAST MAJORITY OF THESE ARE ALREADY EXEMPT OR PERMITTED. UM, SO ANYTIME YOU LOOK AT LIKE A STATE OR A FEDERAL AGENCY OR SCHOOLS, UM, THERE'S EITHER A STATE OR A FEDERAL LAW OR A COURT RULING, WHICH STATES THAT THEY'RE EXEMPT FROM HAVING TO GO THROUGH SPECIAL USE PERMIT PROCESSES FOR DEVELOPMENTS AS AGENCIES. AND WE WANTED WHAT'S WRITTEN IN THE ORDINANCE TO BE IN LINE WITH THAT. SO THERE'S NO CONFUSION WITH THESE OTHER AGENCIES THINKING THAT WE'RE TRYING TO SIDESTEP THE AUTHORITY THAT'S BEEN GRANTED TO THEM TO, UH, TO EXEMPT OUT OR GO AS A PERMITTED USE. THIS WOULD STILL REQUIRE THAT ANY OF THOSE APPLICANTS PROVIDE NOTIFICATION TO THEIR NEIGHBORS WITHIN 300 FEET LIKE YOU HAVE FOR THIS HEARING PROCESS, AND ALLOW THE PUBLIC TO PROVIDE COMMENTS AND ADDRESS ISSUES PRIOR TO GOING FOR THE FULL PERMITTING. IT JUST REMOVES THE SPECIAL USE PERMIT PROCESS BECAUSE OFTENTIMES, AND IN MOST CASES, UH, WE LEGALLY CANNOT REQUIRE IT. UM, SO THAT'S WHY WE TOOK A LOOK AT THIS AS THE, THE FINAL PORTION OF THE UPDATE. BASED ON WHAT I'VE SAID HERE, WE, WE'VE GONE THROUGH AND ANALYZED AND NAVAJO COUNTY PLANNING AND DEVELOPMENT SERVICES STAFF IS RECOMMENDING THE APPROVAL OF THE TEXT AMENDMENT, UM, STAFF'S AVAILABLE FOR ANY QUESTIONS YOU MIGHT HAVE.
